88 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE UPHOLDING THE
RECOMMENDA-TION OF THE PLANNING COMMISSION OF
THE CITY OF ORANGE AND REVISING AND
AMENDING THE STANDARDS PERTAINING TO HIGH
DENSITY RESIDENTIAL DEVELOPMENT CONTAINED
WITHIN THE UPPER PETERS CANYON SPECIFIC
PLAN.WHEREAS, after receiving the recommendation of the
Planning commission in Resolution PC-7-88, the City Council
did hold one duly advertised hearing on April 26, 1988, for
the purpose of considering an amendment to the Ordinance 30-
84 adopting Chapter 3 of Upper Peters Canyon Specific Plan by
which amendment it is proposed to revise and amend the
standards pertaining to high density residential development contained within
the Upper Peter'
s Canyon Specific Plan.WHEREAS, the City Council
hereby finds as follows:1. That an amendment to Chapter 3 of the
Upper Peter's Canyon Specific Plan as approved by Ordinance No.
30-84 is needed to eliminate inconsistencies
and to incorporate standards inadvert-ently
omitted from the original document.2. That modifications to the
Upper Peter's Canyon Specific Plan must be accomplished prior to
final review and approval of site plans for the high
density planning
areas within Santiago Hills development.3. That the setback
requirements for the high density residential areas are more
restrictive than those contained
within the medium density standards.4. That the high density
standards do not directly address setbacks of carports and garages
from private streets and drives.5. That no provisions have
been included within the high density standards for
projections into required setback areas.6. The proposed
amendment will eliminate inconsistencies and correct omissions in the Upper
Peter's Canyon Specific Plan.7. The proposed
amendment will facilitate development of high density residential
projects in the appropriate planning areas, thereby encouraging development of
a full range of housing types within the Upper Peter'
s Canyon Specific Plan area.8. That no one spoke in support of,
or
in opposition to the application.NOW, THEREFORE, THE CITY COUNCIL OF
THE CITY OF ORANGE

That the following amendments and additions be made to section
3.4.3(e)E of Ordinance 30-84 adopting Chapter 3 of the Upper
Peters Canyon Specific Plan is hereby amended to read as
follows:Amend 1 of E to read as
follows:1. The minimum setback from any public or private
street right-of-way line shall be 10 feet
for principal structures and 6 feet for accessory structures. (
Private streets are those roads which are privately maintained
and which provide through access, including loop
roads and collectors.)Amend 2 of E to
read as follows:2. The m1n1mum building setback
from any private driveway shall be three feet as measured
from curb to structure, except that the point of entry to
any carport or garage shall not be located between 7 and 18
feet from the curb. An enclosed garage situated less than 7
feet from any street or drive shall be equipped with
an automatic
garage door opener.Add 6 to E to
read as follows:a. Covered patios, unenclosed on at least
two sides, may abut any side or
rear property line.b. Eaves cornices, chimneys, balconies
and other similar architectural features shall not project more than
4 feet or 2/3 the distance (whichever is less) into
any required front,side
or rear
yard.section VII:A summary of this Ordinance shall be published
and a certified copy of the full text of this Ordinance shall be
posted in the Office of the City Clerk at least five (5) days prior
to the City Council meeting at which this Ordinance is to
be adopted. A summary of this Ordinance shall also be
published once within fifteen (15) days after this Ordinance's passage in
the Orange city News, a newspaper of general circulation,
published, and circulated in the City of Orange. The City Clerk shall post in
the Office of the City Clerk a certified copy of the full text
of such adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance
with Government Code Section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of
its final passage.ADOPTED this
