ORD-30-86 CONCERNING STORAGE AND USE OF HAZARDOUS MATERIALSORDINANCE NO. 30- 86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTERS 15. 32 AND ~5.33 OF THE ORANGE MUNICIPAL CODE CONCERNING STORAGE AND USE OF HAZARDOUS MATERIALS.WHEREAS, Chapter 15.32 of the Orange Municipal Code adopts by reference the 1982 Edition of the Uniform Fire Code and includes, among other matters, certain additions to the Uniform Fire Code concerning the use and storage of hazardous materials; and WHEREAS, needed minor numerical corrections in Sections 15.32.135 and 15.32.136 necessitate amendment; and WHEREAS, Chapter 15.33 of the Orange Municipal Code sets forth the disclosure requirements necessary for the storage and use of hazardous materials; and WHEREAS, the amendment of Subsection 15.33.060C, con-cerning limitations on disclosure, adds those hazardous compressed gases used or handled in quantities of less than 200 cubic feet a year; and WHEREAS, the amendment of Section 15.33.070 will change the $50.00 maximum disclosure fee to allow an increase in fees to cover administrative costs for the hazardous materials disclosure program.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS:Section I:Section 15.32.135 of the Orange Municipal Code is hereby amended to read as follows:15.32.135 Section 80.112 Storage of Hazardous Substances in Underground Tanks. Section 80.112 is hereby added to the Uniform Fire Code to read as follows:Section 80.112 Storage of Hazardous Substances in Underground Tanks. The requlrements of Assembly Bill No. 1362, enacted as Chapter 1046 of the 1983 Statutes, and codified as California Health and Safety Code Section 25150.1 and Sections 25280 through 25299.6 inclusive are hereby adopted by reference as the standards of the City of Orange for the underground storage of hazardous substances."Section II:Section 15.32. 136 of the Orange Municipal Codes is hereby amended to read as follows:15.32.136 Section 80.113 Inventory List of Hazardous Chemicals. Section 80. 113 is hereby added to the Uniform Fire Code to read as follows:Section 80.113 Inventory List of Hazardous Chemicals. Upon request from the Fire Chief, any building or property owner must produce a complete inventory list in writing of all hazardous chem-icals listed in this Article, including any flammable and combustible liquids which are being stored,handled, or mixed on the premises. The hazardous chemical inventory list must include the chemical name, amount of chemical, and any hazard safety data sheets requested by the Fire Department."Section III:Subsection 15.33. 060C of the Orange Municipal Code is hereby amended to read as follows:C. Any person using or handling less than 500 pounds,55 gallons, or 200 cubic feet per year, whichever is the least of a hazardous material, shall be exempt from the requirement of disclosure of that use or handling unless the Fire Chief has provided notice that the weight or volume limits of this exemption for a specific hazardous material has been lowered in response to public health concerns or to meet the intent and requirements of the Uniform Fire Code. Section IV:Section 15.33. 070 of the Orange Municipal Code is hereby amended to read as follows:15.33.070 Fees and Penalties for Late Filing. The Fire Chief may establish a schedule of fees to be paid by persons using or handling hazardous materials which is sufficient to cover the costs to the City of adminis-tering this Ordinance. Said Resolution shall include a schedule of penalties to be assessed for the late filing of any disclosure form.ORD 30-86 2 - Section V: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordi- nance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 25th day of November 1986.
