010L REQUIRING A CONDITIONAL USE PERMIT FOR THE
OPERATION OF BINGO GAMES IN ANY ZONING
DISTRICT.ORDINANCE AMENDMENT 3-86 WHEREAS,
on March 11, 1986, the City Council
adopted Ordinance No. 8-86,
which added Chapter
5.95 to the Orange Municipal Code pertaining to
the operation of bingo games in the City of Orange; and
WHEREAS, the City Council directed that Title 17 of the
Orange Municipal Code be amended
to require the issuance of a Conditional Use Permit to
conduct any bingo game operation in the City; and WHEREAS,
bingo game operations can be conducted only by non-profit
organizations, senior citizen groups
and mobilehome park associations and it is possible that
these organizations may be located in almost
any of the zoning districts within the City; and
WHEREAS, Section 17.92.010 provides a listing of uses which
are unique and
of such a special character that it is impractical to
include them in any specific zoning district;such uses include, but are
not limited to, airports, borrow pits, cemeteries, dumps, heliports,
lots created without frontage on public streets, etc.; and WHEREAS,
the City Council has determined that Section
17.92.010 should be amended
to include the conduct of bingo games in
the listing of uses which require a Conditional Use Permit regardless of
the zoning district where the use will take place.THE CITY
COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:
Section I:
Chapter 17.92 of the Orange Municipal Code is hereby amended
to
add Subsection
L to Section 17.92.010 to read as follows:
L. Operation of bingo games conducted within a
recreation hall, clubroom, church, or similar
facility designed for group activities,
subject to compliance with Chapter 5.95 of
the Orange Municipal Code.
Section II:
A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be
posted in the Office of the City Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall also be
published once within fifteen (l5) days after this Ordinance's
passage in the Orange City News, a newspaper of general
circulation, published and circulated in the City of Orange.
The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of such adopted Ordinance
along with the names of those City Council members voting
for and against the Ordinance in accordance with Government
Code Section 36933. This Ordinance shall take effect thirty
30) days from and after the date of final passage.
