THE CITY OF ORANGE AMENDING CHAPTER 15.
33 OF THE ORANGE MUNICIPAL CODE TO
ADD SECTION 15.33.120 DESIGNATING THE
ORANGE FIRE DEPARTMENT AS ADMINISTERING
AGENCY FOR CALIFORNIA HEALTH AND SAFETY
CODE SECTIONS 25500 THROUGH 25521
CONCERNING COLLECTION OF HAZARDOUS MATERIALS
BUSI-NESS PLAN, DISCLOSURE AND AREA PLAN
DATA.WHEREAS, the City Council of the City of Orange
adopted Ordinance No. 40-85 which adds Chapter 15.33 to
the Orange Municipal Code requiring the disclosure of
specific amounts,types and handling of hazardous
materials; and WHEREAS, the State of California has
also recently adopted Health and Safety Code requirements
pertaining to emergency business plans, emergency response
plans and hazardous materials
disclosure; and WHEREAS, the City Council endorses the
concept that hazardous materials data collection primarily
benefits local emergency services pre-plan,
inspections and emergency
response efforts; and WHEREAS, the City Council hereby
determines that the City of Orange Fire Department is the
proper agency to continue to collect hazardous
materials disclosure data within the
City of Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE
CITY OF ORANGE HEREBY
ORDAINS AS
FOLLOWS:Section I:The Orange Municipal Code is hereby
amended by adding Section 120 to Chapter 15.33 to
read as follows:15.33.120 Designation of
Administering Agency for Health and Safety Code Sections 25500
through 25521. A.The City of Orange Fire Department is
hereby established as the Administering Agency to enforce Health
and Safety Code Sections 25500 through 25521 pertaining to
the location and collection of
B. Inthe event and to the
extent that Sections 25500 through 25521 of the Health and Safety
Code are in conflict with other disclosure requirements of this Chapter,
the most restrictive requirement shall apply.Section II:A
summary of this Ordinance
shall be
published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City
Clerk at least five (5)days prior to the City Council meeting
at which this Ordinance is to be adopted. A summary of
this Ordinance shall also be published once within fifteen (15) days after
this Ordinance's passage in the Orange City News, a
newspaper of general circulation, published and circulated in the City
of Orange.The City Clerk shall post in the
Office of the City Clerk a certified copy of the full text of
such adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance
with Government Code Section 36933. This Ordinance shall take
effect thirty 30) days from and after the date
of final passage.ADOPTED this 24th day of June 1986.
