AMENDMENT NO.1-85 REVISING
TOWER ANTENNA REGULATIONS OF THE ORANGE MUNICIPAL
CODE BY ENACTING STANDARDS FOR THE
CONSTRUCTION OF AMATEUR
RADIO COMMUNICATION ANTENNAS.
CITY OF ORANGE
AMENDMENT NO. 1-85 WHEREAS, the
existing ordinances and regulations governing the construction,
operation and maintenance of antennas in the City of Orange
are inadequate to cover changing
technologies and types; and WHEREAS, the City of Orange
desires to continue to maintain the pleasing aesthetic
quality of its residential areas by regulating the numbers, height
and bulk of amateur
radio communication antennas; and WHEREAS, the amateur
radio antenna regulations here-inafter set forth allow the use of
such antennas subject to restrictions on placement, size, and
height to protect the environmental quality of life in the
City of Orange; and WHEREAS, the City of Orange
desires to allow amateur radio communication antennas
in residential, commercial, and industrial areas of the City
subject to regulations to prevent such antennas from
creating a negative environmental impact
on neighboring properties; and WHEREAS, these
regulations nevertheless allow "ham"radio operators to have an
antenna to effectively communi-
cate world wide; and WHEREAS, these regulations
have heretofore been con-sidered and recommended to the City
Council by the Planning Commission in
Resolution No. PC 88-85.NOW, THEREFORE, THE CITY COUNCIL
OF THE CITY OF
Section I:
That a new Chapter 17.73 be added to the Orange Muni-
cipal Code to read as follows:

Purpose and Intent.
Definitions.
Regulations.
17.73.010 Purpose and Intent. The purpose of this
Chpater is to permit amateur radio communication antennas
subject to regulations designed to reduce adverse environ-
mental impact created by their construction and use.
17.73.020 Definitions. A. Antenna: "Antenna" means
any system of wires, poles, rods, reflecting discs, or
similar devices used for the transmission or reception of
electromagnetic waves, including devices having active
elements extending in any direction and directional para-
sitic arrays having elements attached to a generally hori-
zontal boom which may be mounted upon a vertical support
structure which system is designed to permit communication
through the use of amateur radio communication equipment.
B. Self Supporting Telescoping Tower: "Self Support-
ing Telescoping Tower" means an antenna mast which requires
no guy wires, and which is capable of being retracted or
extended to vary its height above ground.
C. Antenna Height: "Antenna Height" means the dis-
tance between the ground level and the highest portion of an
antenna.
D. Antenna Mast: "Antenna Mast" means the pole or
tower of metal or wood used to support antennas.
E. Antenna Radius: "Antenna Radius" is the distance
from the antenna support structure to the furthest possible
extension of any horizontal element of an antenna.
17.73.030 Regulations. A. Number: One mast shall be
permitted per lot. No more than three antennas may be
mounted per mast and provided, futher, that no antennas or
antenna wires shall be attached to ballons.

B. Height: Maximum height of a mast or an antenna
shall be fifty (50) feet. However, the maximum height of an
antenna mounted upon a self supporting telescoping tower may
exceed the limit by sixteen (16) feet, provided that the
highest portion of the antenna is kept at the fifty (50)
foot height limit at all times when the antenna is not in
use. Further provided that upon proof that the owner or
person in control of the antenna has been determined by the
State of California to be handicapped, the requirement to
retract the self-supporting telescoping tower to
maintain the maximum height of fifty feet when not in use may
be waived by the Zoning
Administrator.C. Location: An antenna mast not roof mounted
shall be located behind the main structure and no closer than
ten 10) feet to the rear and side property lines (in case
of corner lots, fifteen (15) feet from the street side
property line). A roof mounted antenna shall be kept to the rear
of the center line of the main structure. Horizontal
antenna elements shall be located to the rear of the center line
of the main building and not extend beyond the property
line.Section
II:That Section 17.72.010 of the orange Municipal
Code be amended to read as
follows:Add the words "tower antennas" between the word "
wind-mills," and the word "
and."Section
III:That Section 17.94.060 of the Orange Municipal
Code be amended to read as
follows:Add subsection H to read as
follows:H. Waiver of antenna requirements for height,
loca-tion, site, and
setbacks."Section
IV:That Section 17.10.490 of the Orange Municipal
Code which currently regulates antennas in residential
zoning districts be
deleted.Section
V:A summary of this Ordinance shall be published and
a certified copy of the full text of this Ordinance shall
be posted in the Office of the City Clerk at least five (
5)days prior to the City Council meeting at which this
Ordi-nance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after

Ordinance's passage in the Orange City News, a newspaper of
general circulation, pUblished and circulated in the City of
Orange. The City Clerk shall post in the Office of the City
Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members
voting for and against the Ordinance in accordance with
Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final
passage.
