THE CITY OF ORANGE AMENDING CHAPTER 15.41
OF THE ORANGE MUNICIPAL CODE
ESTABLISHING TRANSPORTATION SYSTEMS IMPROVEMENT
PROGRAM AREA "D," TO INCLUDE ALL REAL
PROPERTY WITHIN THE CITY WEST OF THE ORANGE (
ROUTE 57) FREEWAY AND ALL
COMMERCIALLY-ZONED REAL PROPERTY ADJACENT TO
CHAPMAN AVENUE BETWEEN MAIN STREET AND THE
ORANGE (ROUTE
57) FREEWAY.WHEREAS, the City of Orange has created
the Transportation Systems Improvement Program to identify and
designate those areas of the City where the transportation
system may experience a significant reduction in the level
of service unless corrective measures are taken concurrent
with traffic
demands; and WHEREAS, the City Council has previously
created three so-called T.S.I.P. areas in which
corrective measures are
being taken; and WHEREAS, after a duly-held
public hearing, the Council has determined that a
fourth area, Transportation System Improvement Program Area "A"
should be created; and WHEREAS, said Area "D" shall
include all real property within the City's corporate limits west
of the Orange (Route 57) Freeway and all
commercially-zoned real property adjacent to Chapman Avenue between Main
Street and
the Orange (Route 57) Freeway.NOW, THEREFORE, THE CITY COUNCIL
OF THE CITY OF
ORANGE DOES
ORDAIN AS FOLLOWS:Section I:Section 15.41.060 of Chapter 15.
41 of the Orange Municipal Code is hereby amended
by adding the following paragraph after Transportation Systems Improvement
Area "
c" to read as follows:Transportation Systems
Improvement Program Area "D": Fee:Two percent (2%) of the est~
mated cost of construction or improvement. General
Description: Area west of Orange Route 57) Freeway - Chapman Avenue
between Main Street and
Section II:
A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be
posted in the Office of the City Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall also be
published once within fifteen (15) days after this Ordinance's
passage in the Orange City News, a newspaper of general
circulation, published and circulated in the City of Orange.
The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of such adopted Ordinance
along with the names of those city Council members voting
for and against the Ordinance in accordance with Government
Code Section 36933. This Ordinance shall take effect thirty
30) days from and after the date of its final passage.
