ORD-29-85 URGENCY MEASURE TO CONTINUE TO REGULATE THE CONSTRUCTION OF ANTENNAS DESIGNED TO RECIEVE RADIO TELEVISION OR MICROWAVE SIGNALSORDINANCE NO. 29- 85 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE TO CONTINUE TO REGULATE THE CON-STRUCTION OF ANTENNAS DESIGNED TO RECEIVE RADIO, TELEVISION, OR MICROWAVE SIGNALS LOCATED ON PROPERTY ZONED OR DEVELOPED FOR RESIDENTIAL USE AS SET FORTH IN PRIOR ORDINANCE NO. 19-85.WHEREAS, the City Council of the City of Orange enacted Ordinance No. 19-85, an Interim Ordinance adopted as an urgency measure, to regulate the construction of antennas designed to receive radio, television, or microwave signals located on property zoned or developed for residential use;and WHEREAS, said Interim Ordinance is scheduled to termi-nate approximately June 28, 1985, unless the City Council takes further action; and WHEREAS, a proposed permanent ordinance is being con-sidered in study by the Planning Staff and the City Planning Commission and will be further discussed in July and August of 1985; and WHEREAS, additional time is necessary for the Planning Commission to consider a permanent ordinance and for the City Council to adopt, reject, or modify any such permanent ordinance; and WHEREAS, Section 65858 of the Government Code provides that interim ordinances adopted as urgency measures may be further extended after notice of public hearing; and WHEREAS, the City Council has heretofore on June 18,1985, conducted a public hearing in which the question of continuing the aforementioned Interim Ordinance was duly considered after prior legal notice in accordance with law; and WHEREAS, one person appeared in opposition to the Interim Ordinance and one person appeared in support of said Ordinance; and WHEREAS, the City Council has determined that an addi-tional period of not to exceed eight (8) months from June 18,1985, is needed by the Planning Commission and Planning Staff to study and develop a permanent ordinance WHEREAS, the Planning commission and City Council will, within the next few months, consider the adoption of a perma- nent ordinance regulating antennas. NOW, BE IT HEREBY ORDAINED by the City Council of the City of Orange that the provisions of Interim Ordinance No. 19-85 shall continue for a period of not to exceed eight 8) months from June 18, 1985, or until an earlier date when an ordinance regulating construction of antennas designed to receive radio, television, or microwave signals located on property zoned or developed for residential use has been duly considered and adopted by the City Council and has become effective or is rejected or modified by the City Council, whichever first occurs.Section II:The reasons for this urgency are as follows:The City Council has observed that many large antennas for the receiving of radio, television, or microwave signals have been constructed on lots zoned and developed for resi-dential use in the City and that such antennas have been found to be excessive in size in relation to the size of the lot devoted to residential use. Therefore, the Council has determined that the size and locations of such antennas on properties zoned or developed for residential use in the City is a problem which should be studied by the City staff and Planning Commission with the objective of determining whether there should be limitations placed on the maximum diameter and height of such antennas.During the study of this subject of antennas, the City Council is of the opinion that all construction of the described antennas on properties zoned or developed for residential use in the City should be limited to antennas of the herein specified maximum size and height during the time this study is in progress. Therefore, the City Council has determined that no building permit should be issued for antennas exceeding the aforementioned maximum heights and diameters prior to the completion of this study. This study is now estimated to require a periOd of eight (8) months from June 18, 1985 or such shorter time as may be required to present to the City Council a completed proposal for permanent regulation of antenna construction.Ord. No. 29- THE CITY COUNCIL OF THE CITY OF ORANGE hereby enacts this ordinance as an urgency measure in order to protect the public health, safety, and welfare.
