85 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE PROHIBITING STOPPING
AT ANY TIME OF ANY VEHICLES TRAVELING
ON CHAPMAN AVENUE FROM TUSTIN STREET
TO CRAWFORD CANYON ROAD, BUT
EXCEPTING FROM THIS PROHIBITION ENTITIES
OPERAT-ING BUSES WHICH AS COMMON CARRIERS
OF PASSENGERS HAVE PRESENTED EVIDENCE
OF SUCH STATUS TO THE
CITY.WHEREAS, the demands of an ever increasing volume of
traffic traveling on Tustin Street demands that Chapman Avenue east
of Tustin Street to Crawford Canyon Road be rendered capable
of carrying greater volumes of vehicular traffic;
and WHEREAS, the portion of Chapman Avenue frQu tile Plaza
to Tustin Street has already been designated to prevent stopping
of vehicles at any time in order to permit travel along the
curb lanes on the north and south edge of Chapman Avenue in areas
west of Tustin Street;
and WHEREAS, it has now become necessary to increase the
vehicular traffic carrying capacity of that portion of Chapman Avenue
lying east of Tustin extending to Crawford Canyon Road;
and WHEREAS, the question of whether to prohibit the stopping
of vehicles on this portion of Chapman Avenue east of Tustin
Street has had several public hearings in which the citizens and
property owners have been permitted to address the City Council and
express their views;
and WHEREAS, as a result of these public hearings and based upon
a consideration of all matters presented by the Traffic Engineer
and other members of the City staff, the City Council has
concluded that the demand to effectively move vehicle traffic on
Chapman Avenue east of Tustin Street to Crawford Canyon Road requires
the enactment of the hereinafter described ordinance to prohibit
the stopping as the term "stopping" is used in the California
Vehicle Code on that portion of Chapman Avenue east of Tustin Street
to Crawford Canyon Raod;
and WHEREAS, as a result of the aforementioned public
hearings,the City Council has also concluded that the provisions of
this ordinance prohibiting parking on the north and south sides
of Chapman Avenue from Tustin Street to Crawford Canyon Road
should not become effective until a period of 120 days has elapsed
from the date of the final hearing on this matter, to wit: May
21,1985;
and
WHEREAS, Section 10.38.020 of the Orange Municipal Code
permits the City Council to establish by motion or resolution no
stopping zones on various streets; and
WHEREAS, the City Council has determined to utilize an
ordinance in this particular instance involving Chapman Avenue in
view of the fact that the effective date of the prohibition is not
critical in this case inasmuch as the City Council has determined
that the provisions of the prohibition against stopping should not
apply for 120 days from May 21, 1985, in order to permit the
residents and property owners to develop alternative locations for
parking vehicles; and
WHEREAS, the City Council is also determined that the
prohibition against the stopping of vehicles should not include
buses which have been certified as common carriers to transport
passengers.
NOW, THEREFORE, the City Council of the City of Orange hereby
Ordains as follows:
SECTION I:
Pursuant to the authority of Section 10.38.020 of the Orange
Municipal Code, the City Council hereby ordains as follows:
On and after September 21, 1985, it shall be unlawful for any
vehicle to stop as the term "stop" is defined in Section 587 of
the California Vehicle Code on either the north or south curb
lines or right-of-way line of Chapman Avenue easterly
from Tustin Street to Crawford
Canyon Road.Provided, however, that the foregoing prohibition
shall not apply to buses operating as common carriers of
passengers by entities which have presented evidence of such status to
the City.Provided further that the foregoing
prohibition governing stopping of vehicles shall not be effective
until the aforementioned portion of Chapman Avenue has been
posted with signs prohibiting the stopping
of vehicles.
SECTION II:A summary of this Ordinance shall be published and
a certified copy of the full text of this Ordinance shall be posted
in the Office of the City Clerk at least five (5) days prior to
the City Council meeting at which this Ordinance is to be
adopted. A summary of this Ordinance shall also be published
once within fifteen (15) days after this Ordinance's passage in
the Orange City News, a newspaper of general circulation,
published and circulated in the City of Orange. The City Clerk shall
post in the Office of the City Clerk a certified copy of tile full
text of such adopted Ordinance along with the names of those
City Council Ord. No. 21-85

members voting for and against the Ordinance in accordance with
Government Code Section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of its final passage.
