ORD-20-85 PERMITS THE RECOVERY OF COST OF NUISANCE ABATEMENT AGAINST THE PROPERTY ON WHICH SAID NUISANCE IS LOCATED OR AGAINST THE PERSON WHO HAS CAUSED THE NUISANCEORDINANCE NO. 20- 85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 1.08. 020 OF THE ORANGE MUNICIPAL CODE BY ADDING THERETO PROVISIONS PERMITTING THE RECOVERY BY THE CITY OF THE COST OF NUISANCE ABATE-MENT AGAINST THE PROPERTY ON WHICH SAID NUISANCE IS LOCATED OR AGAINST THE PERSON WHO HAS CAUSED SUCH NUISANCE TO EXIST.WHEREAS, Sections 38773 and 38773.5 of the California Government Code permit the City by Ordinance to make the cost of abatement of a nuisance on a parcel of land a special assessment against that parcel of land and a personal obligation against the property owner; and WHEREAS, the City Council of the City of Orange desires to insure that this provision for cost recovery for abatement of nuisances is clearly specified by Ordinance and incorporated in the Orange Municipal Code.NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City of Orange that the following provision be added to Section 1.08.020 of the Orange Municipal Code to read as follows:Section I:Add the following as an additional paragraph to Section 1.08. 020:Any cost or expense to the City of Orange to abate any nuisance or nuisances shall constitute a lien against the property on which said nuisance or nuisances are located or maintained and such cost or expense of abatement by the City shall also be a personal obligation against the property owner.The cost to the City of abatement of any nuisance on a parcel of land shall constitute a special assessment against that parcel and may be collected at the same time and in the same manner as ordinary municipal taxes are collected, and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for ordinary municipal taxes. "Section II:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 28 th day of May 1985.
