85 AN INTERIM ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN
UR-GENCY MEASURE REGULATING THE
CONSTRUC-TION OF ANTENNAS DESIGNED TO
RECEIVE RADIO, TELEVISION, OR MICROWAVE
SIGNALS LOCATED ON PROPERTIES ZONED OR
DEVELOPED FOR RESIDENTIAL
USE.WHEREAS, The City Council has determined that it
is essential that the subject of the construction of
antennas designed to receive radio, television, or microwave
signals located on residentially zoned or developed properties
be studied and that the City should determine whether
an ordinance or ordinances should be enacted
establishing appropriate regulations regarding size and location
of antennas on such residential properties;
and WHEREAS, the Council has determined that the City
staff and Planning Commission should study this problem as soon
as possible;
and WHEREAS, Section 65858 of the Government Code of
the State of California permits the Council to adopt as
an urgency measure, an interim ordinance limiting the
maximum height and diameter of the herein described antennas
located on residentially zoned or developed lots or parcels
while the City studies the enactment of such an
appropriate ordinance or ordinances;
and WHEREAS, Section 65858 of the Government Code
permits this ordinance adopted as an urgency measure to be
effective for forty five (45) days from the date of its adoption
to permit such study by the City;
and WHEREAS, such interim ordinance adopted as an
urgency measure may be further extended after notice and
public hearing;
and WHEREAS, the City Council has determined that
the subject of the size and location of radio and
television antennas on residential properties should be studied with
a view to possibly revising the current ordinances
governing the construction of antennas in the
City.NOW, BE IT HEREBY ORDAINED by the City Council of
the City of Orange that the following be enacted as an
interim ordinance adopted as an urgency measure to be
effective while the subject of construction and installation of
antennas designed to receive radio, television, or microwave
signals located on residentially zoned or utilized properties can
be further studied by City staff and the Planning
Section I:
Notwithstanding any provisions of the Orange Municipal
Code to the contrary the following requirements shall govern
the construction of any antenna designed to receive radio,
television, or microwave signals located on any property
zoned or developed for residential use in the City of Orange:
1. Antennas which are less than three (3) feet in
diameter are permitted to be installed or constructed on any
property in the City of Orange which is zoned or used for
residential purposes provided such antennas do not exceed
thirty (30) feet in height above grade or twenty (20) feet
in height above any existing structure when such antenna is
installed or constructed on any roof of said structure.
2. Antennas which exceed three (3) feet in diameter
are permitted to be installed or constructed on any property
in the City of Orange which is zoned or used for residential
purposes provided such antennas are located on said property
in such a manner as not to be visible either from any property
other than the property on which antenna is located or from
any public street.
3. No antenna shall be constructed or erected in any
property zoned or developed for residential use if such
antenna would be located within any of the yards required by
the Orange Municipal Code. Provided, however, that guy
wires and similar support devices for the antenna may be
placed in such required yards.
4. No property zoned or used for residential use
shall be permitted to have more than one such antenna described
herein per lot or parcel of real property.
Compliance with the provisions of this interim ordi-
nance shall not be construed to relieve any person, firm, or
entity from the requirements of any other laws, ordinances,
or regulations governing construction of antennas or similar
structures.
Section II:
The reasons for this urgency are as follows:
The City Council has observed that many large antennas
for the receiving of radio, television, or microwave signals
have been constructed on lots zoned and developed for resi-
dential use in the City and that such antennas have been
found to be excessive in size in relation to the size of the
lot devoted to residential use. Therefore, the Council has
determined that the size and locations of such antennas on
properties zoned or developed for residential use in the
City is a problem which should be studied by the City staff
and Planning Commission with the objective of determining
whether there should be limitations placed on the maximum
diameter and height of such antennas.

During the study of this subject of antennas, the City
Council is of the opinion that all construction of the
described antennas on properties zoned or developed for
residential use in the City should be limited to antennas of
the herein specified maximum size and height during the time
this study is in progress. Therefore, the City Council has
determined that no building permit should be issued for
antennas exceeding the aforementioned maximum heights and
diameters prior to the completion of this study.
THE CITY COUNCIL OF THE CITY OF ORANGE hereby enacts this
ordinance as an urgency measure in order to protect the
public health, safety, and welfare.
