ORD-10-85 ALLOW SELF STORAGE FACILITIES OR MINI WAREHOUSES IN ZONES OTHER THAN R-1 R-D O-P C-P SUBJECT TO APPROVAL OF A CONDITIONAL USE PERMITORDINANCE NO. 10- 85 AN ORDINANCE or THE CIT1 COUNCIL or THE CIT1 or ORANGE UPHOLDING, IN PART, THE RECOMMENDATION or THE PLANNING COMMISSION or THE CITY OF ORANGE, AND AMENDING THE ORANGE MUNICIPAL CODE BY REVISING SECTION 17.92.010 AND BY ADDING TO SAID SECTION SUBSECTION (K) TO ALLOW SELF STORAGE FACILITIES OR MINI-WAREHOUSES IN ZONES OTHER THAN R-I, R-D, O-P, AND C-P SUBJECT TO APPROVAL OF A CONDITIONAL USE PERMIT.CITY OF ORANGE RECITALS:After due public hearings as required by law, the City Council considered Planning Commission Resolution No. PC 55-84 recommending approval of self storage facilities, or mini-warehouses in zones other than C-2, C-3, M-I and M-2 by issuance of a Conditional Use Permit and upheld the recommenda-tion of the Planning Commission, in part, subject to the modifications hereinafter set forth.Upon the public hearing before the City Council the following facts were determined:1. Mini-warehouse development is currently a permitted use in the C-2, C-3, M-I and M-2 zones. There is at present no procedure to allow such development in other zones.2. Mini-warehouse development is typically character-ized by low vehicular traffic generation. Cal Trans trip generation Research Counts indicate that average daily trips are 0.28 per storage unit or 50 per acre, which is comparable to the amount of traffic generated by a single-family detached subdivision.3. Mini-warehouse development is also typically characterized by low noise generation. Because traffic volumes are low, noise generation from such development is also low. Restricting such use to storage only would 4. Because of these characteristics, mini- warehouse development is felt to be a non- intrusive land use, and can be utilized as an appropriate buffer between non-compatible land uses such as industrial and residential, and between residential and other noise generating uses such as freeways and railways.5. Additionally, it is felt that mini-warehouse development can be compatible with high activity/noise land uses because of the lack of people on site to be affected by such uses, and with low activity/noise land uses because such development itself has a low level of activity and produces little traffic or noise.6. These characteristics indicate that mini-warehouse development is a unique type of land use, and as such can also be appropriate in areas which are zoned other than C-2, C-3, M-l and M-2.7. However, after reviewing the testimony presented at the public hearing, the Council has reached the following conclusions concerning the Amendment of Section 17.92.010 of the Orange Municipal Code:a. All uses listed in Section 17.92.010 should be subject to approval of a Conditional Use Permit by the City Council after receipt of a recommendation from the Planning Commission with no provision for any final determination by the Planning Commission pursuant to a Conditional Use Permit for any uses listed in Section 17.92.010.b. Self Storage facilities or Mini-Warehouses should also be permitted by approval of a Conditional Use Permit by the City Council after receipt of a recommendation by the Planning Commission, but such self storage developments are inherently incompatible with uses permitted in R-l, R- D, O-P, and C-P zones and should not be allowed in these zones.8. Site plan review by the Planning Commission and final approval by the City Council through the Conditional Use Permit process can be expected to result in the imposition of approj:;rlate conditions relating to building height, setback, access and driveway locations, parking, security and safety allowed to insure that each self storage develop- ment will be compatible with surrounding land uses when placed in zones other than R-l, R-D, O-P and C-P by Council approval of a Conditional Use Permit.9. That one (1) person spoke in favor two (2) spoke against the proposal at least unless such uses were excluded from certain zones, including single-family residential zones.NOW, THEREFORE, THE COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:Section I:Section 17.92.010 of the Orange Municipal Code is hereby amended to read as follows:The following uses are unique and of such special form as to make impractical their inclusion into any specific zone classification, and may be permitted by the issuance of a conditional use permit by the City Council upon recommenda-tion of the Planning Commission, pursuant to Section 17. 92.040 of this Code.Section II:Subsection (k) is hereby added to Section 17.92.010 of the Orange Municipal Code to read as follows:Self storage facilities or mini-warehouses except in the R-l, R-D, O-P, or C-P zones.Section III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5)days prior to the City Council meeting at which this OrdinanCe is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange.The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City for and against the Ordinance in accordance with Government Code Section 36933.
