84 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING CHAPTER 15.
32 OF THE ORANGE MUNICIPAL CODE BY
ADDING SECTION 15.32.134 CONCERNING
REQUIREMENT TO REPORT IMMEDIATELY THE RELEASE
OF HAZARDOUS MATERIALS OR
UNCONTROLLED CHEMICAL REACTIONS TO THE FIRE
DEPART-
MENT.WHEREAS, the Uniform Fire Code, adopted by the City
of Orange, requires that when a fire occurs on any
property,the owner or occupant must immediately report such
event fire to the Fire Department;
and WHEREAS, the uncontrolled release of hazardous
materials or chemical reactions may also result in fires and the
death and injury to persons;
and WHEREAS, uncontrolled hazardous materials have
the further potential of polluting the air and contaminating
the water supply;
and WHEREAS, the Orange Fire Department has the
resources available to neutralize or remove such dangerous
substances,thereby eliminating or greatly mitigating the risk of
harm to persons and property when such events are
reported immediately;
and WHEREAS, the City Council views the danger of spills
of hazardous materials and uncontrolled chemical reactions
to pose as great a threat to the public health, safety
and welfare of the citizens of Orange as fires;
and WHEREAS, the City Council finds and determines that
a requirement that the owner or occupant to report the
release of hazardous materials and uncontrolled chemical
reactions to be reasonable and to be in the best interests of
the citizens of the City of
Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN AS
FOLLOWS:Section
I:Chapter 15.32 of the Orange Municipal Code is
hereby amended by adding Section 15.32.134 to read as
follows:15.32.134 Section 80.103(j) Reporting
Hazardous Materials Release or Uncontrolled

Section SO.l03(j) is hereby added to the Uniform Fire
Code to read as follows:
Section 80.i03(j) Reporting Hazardous Materials
Release or Uncontrolled Reactions.
In the event a hazardous materials release or controlled
reaction occurs on any property, the owner or occupant
shall immediately report such release or uncontrolled
reaction to the Fire Department. A hazardous materials
release or uncontrolled reaction is a release or reaction
of hazardous materials or combination of hazardous
materials as defined in this article which are not part
of the normal business production process or activity
and which may result in fire, injury or death.
Section II:
A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be
posted in the Office of the City Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall also be
pUblished once within fifteen (15) days after this Ordinance's
passage in the Orange City News, a newspaper of general
circulation, published and circulated in the City of Orange.
The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of such adopted Ordinance
along with the names of those City Council members voting
for and against the Ordinance in accordance with Government
Code Section 36933. This Ordinance shall take effect thirty
30) days from and after the date of its final passage.
