ORD-36-84 MINIMUM DIMENSIONS OF SIGNS PROHIBITING PUBLIC PARKING AND INDICATING VEHICLES WILL BE REMOVED AT OWNERS EXPENSE1 ORDINANCE NO. 36- 84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING THE ORANGE MUNI-CIPAL CODE BY ADDING CHAPTER 10.75 SETTING FORTH THE MINIMUM DIMENSIONS OF SIGNS PROHIBITING PUBLIC PARKING AND INDICATING THAT VEHICLES WILL BE REMOVED AT OWNER' S EXPENSE AS PROVIDED IN SECTION 22658 OF THE CALIFORNIA VEHICLE CODE.WHEREAS, Section 22658 of the California Vehicle Code sets forth the requirements which must be fulfilled before an owner or person in lawful possession of private property can cause the removal of a vehicle parked on the property to the nearest public garage; and WHEREAS, the State of California by the adoption of Section 22658 of the California Vehicle Code has preempted local jurisdictions from establishing additional requirements,except said section does provide that the size of notice signs may be specified by local ordinance; and WHEREAS, the Traffic Bureau of the Orange Police Depart-ment has recommended to the City Council that the minimum dimensions of such notice signs should be no less than 18 inches by 24 inches.The City Council of the City of Orange does hereby ordain as follows:Section I:Chapter 10.75 is hereby added to the Orange Municipal Code to read as follows:Chapter 10. 75 REMOVAL OF VEHICLES FROM PRIVATE PROPERTY Sections:10.75.010 Authority and Requirements for Removal of Vehicles from Private Property.10.75.020 Minimum Requirements for Warning Signs.10.75.010 Authority and Requirements for Removal of Vehicles from Private Property. The authority and the requirements which must be satisfied by the owner or person in lawful possession of private property before causing removal of a vehicle from that property are set forth in California Vehicle Code Section 22658. These are precise and should be adhered to carefully. Failure to adhere to these requirements may result in liability for the owner or person in lawful possession of the private property. 10.75.020 Minimum Requirements for Warning Si'lns. Prior to causing the removal of any vehicle from pr~vate property where the posting of warning signs are required, the owner or person in lawful possession of the property shall insure that the warning signs meet the following requirements: 1. The outside dimensions of each sign shall be no less than 18 inches by 24 inches. 2. Each sign shall state clearly "NO PARKING - TOW AWAY" and "UNAUTHORIZED VEHICLES WILL BE TOWED AWAY AT VEHICLE OWNER'S EXPENSE."3.
