ORD-28-84 PROVIDES FOR THE USE OF PARKS FOR VETERINARIAN SERVICESBY NON PROFIT ORGANIZATIONSJL_ ORDINANCE NO. 28- 84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 12.48. 020 OF THE ORANGE MUNICIPAL CODE TO PROVIDE FOR THE USE OF PUBLIC PARKS FOR VETERI-NARIAN SERVICES BY NON- PROFIT CORPORATIONS.WHEREAS, the City Council of the City of Orange takes cogni-zance of the problems created by having vendors in public parks;and WHEREAS, California Government Code Section 37361 provides that the use of public parks are subject to regulation which may be imposed by the legislative body of the municipality; and WHEREAS, California Vehicle Code Section 21113 grants the City council the power to regulate animals in public parks; and WHEREAS, the City Council of the City of Orange desires to permit vaccination services to be provided in public parks by accredited veterinarians pursuant to California Agricultural Code Section 10302; and WHEREAS, the City Council of the City of Orange desires that the vaccination services be provided by non- profit corporations to its citizens pursuant to its authority under California Vehicle Code section 21113, Orange Municipal Code Section 12. 48.020 and California Government Code Section 37361.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Subsection 1 of Section 12.48.020 of the Orange Municipal Code is hereby amended to read as follows:1. Hitch, cast, lead, drive or let loose any animal or fowl of any kind; provided, however, that notwithstanding the provisions of Section 6.04.040, the City Council may grant permission to non-profit entities approved for exemption by Internal Revenue Service of the United States to provide vaccination services and may grant permission to any person or corporation to conduct animal shows, rides or carnivals having animals, under such conditions as the City council may determine; such conditions shall be for the purpose of protecting the City park against damage, and to assure cleanliness, to protect the City against liability for injuries to persons and damages to property, and for the preservation of the public health and safety.SECTION II:If any section, subsection, sentenc~, cl~use or phras~tot,thi~Ordinance is for any reason held to be ~nval~d bythe decisionof any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, sentence,clause and phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION III:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
