ORD-20-84 URGENCY MEASURE AMENDING SECTION 13.60.030 OF THE OMC TO REVISE TRASH DISPOSAL CONTRACTOR CHARGESORDINANCE NO. 20- 84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE AMENDING SECTION 13.60.030 OF THE ORANGE MUNICIPAL CODE TO REVISE TRASH DISPOSAL CONTRACTOR CHARGES.WHEREAS, negotiations concerning the Orange Disposal Service rate increase request were concluded on April 17, 1984; and WHEREAS, the City Council Solid Waste Committee prepared its report and submitted recommendations to the City Council on April 19, 1984; and WHEREAS, the recommended rates contain a surcharge in the amount of 1.52% which shall only be in effect through December 31,1984; and WHEREAS, at the meeting of April 24, 1984, the City Council approved the Solid Waste Committee' s report and a Letter of Understanding with Orange Disposal Service; and WHEREAS, the Letter of Understanding is a commitment by the parties to amend their present agreement at a future date, except that the rates set forth in Orange Municipal Code Section 13.60.030 shall be modified as soon as possible; and WHEREAS, the City Council has determined that this ordinance shall be adopted as an urgency measure for the preservation of the public health because it is vital that there be no disruption in the disposal of trash and garbage accumulated at commercial establishments and apartment complexes. Such disruption may occur if the revised rates previously approved by the Council are not implemented immediately.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 13.60.030 of Chapter 13.60 of the Orange Municipal Code shall be amended to read as follows:13.60.030 Trash Disposal Contractor--Charges. Unless this urgency ordinance is enacted to become effective as soon as possible there may be a delay in providing this needed service. An ordinance enacted pursuant to the regularly established procedure would require five or six weeks from the date it is introduced to become effective.THEREFORE, pursuant to the procedures of Section 36937 of the California Government Code, the City Council hereby enacts this ordinance as an urgency measure to become effective immediately in order to protest the public health, safety and welfare until the time that the permanent ordinance becomes effective.SECTION III:This Urgency Ordinance shall become effective immediately and shall remain in effect until Ordinance No. 21-84 becomes effective.When Ordinance No. 21-84 becomes effective, this Urgency Ordinance shall become null and void without further action of the City Council.ADOPTED this ay of 1984.Attest:range 1? u~~W~~d4Z/City Cler of e ' y of Orange STATE OF CALIFORNIA COUNTY OF ORANGE CITY OF ORANGE ss I, MARILYN J.
