THE CITY OF ORANGE ADDING SECTION 17.10.
030K TO THE ORANGE MUNICIPAL CODE TO
PERMIT GARAGE OR YARD SALES IN RESIDENTIAL
DIS-TRICTS SUBJECT TO CERTAIN
REGULATIONS.WHEREAS, informal retail sales operations have taken place
in residential districts;
and WHEREAS, the Code Enforcement Officer and Business
License Inspectors have noted an increase in new merchandise being sold
in residential districts;
and WHEREAS, the City Council of the City of Orange desires
to maintain the residential nature of residential districts;
and WHEREAS, the City Council of the City of Orange desires
to continue to allow the occasional and incidental sale of used
items which were part of a reasonable household use;
and WHEREAS, the City Council of the City of Orange desires
to insure that commercial activities remain in the commercial
dis-tricts;
and WHEREAS, the City Council of the City of Orange desires
to insure that garage and yard sales do not become public
nuisances.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS
FOLLOWS:SECTION
I:Subsection K is hereby added to Orange Municipal Code
Section 17.10.030 to read as
follows:K. Garage or yard sales events are permitted subject
to the following
conditions:1. A sales event shall take place at one address no
more often than once every four (4) months, except that the Director
of Planning and Development Services may authorize one or more
addi-tional sales events at one address wi thin a four-month
period in accordance with standards established by him and approved

Any person aggrieved by the action of the Director of Planning
and Development Service by either authorizing or denying an
additional sales event shall have the right to appeal the matter
to the City Council for final determination.2. A
sales event may continue for up to a maximum of four 4) consecutive
days. When a sales event has begun and is actually interrupted
by inclement weather, the sales event period may be
extended by an additional sales day for each day of actual interruption until .
there. is a total of not more than four (4)sales days.
3. A
sales event shall take place between the hours of 8:00 a.m.
and 8:00 p.m.4. Items
to be sold at a sales event shall be "used" items which were
part of a reasonable household use. That is to say,new merchandise
or new goods shall not be brought in from another location for
the purpose of being displayed or sold at a sales event. The
term "a reasonable household use" shall be construed broadly in
favor of the sale of the item.5. No
sign advertising the sales event may be placed or maintained upon
any portion of a public right-of-way including
street signs, street trees, or utility poles.

No item for sale or advertising sign shall obstruct any
sidewalk, parkway, or driveway.
7.Any violation of this subsection shall be an infraction.
SECTION II:
A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be posted
in the Office of the City Clerk at least five (5) days prior to
the City Council meeting at which this Ordinance is to be adopted.
A summary of this Ordinance shall also be published once within
fifteen (15) days after this Ordinance's passage in the Orange
City News, a newspaper of general circulation, published and
circulated in the City of Orange. The City Clerk shall post in
the Office of the City Clerk a certified copy of the full text of
such adopted Ordinance along with the names of those City Council
members voting for and against the Ordinance in accordance with
ORD. 17-84 2 -
Government Code Section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of its final passage.
