11....-_.SECTION
II:The
reasons for the urgency of this ordinance are as follows:Substances
hazardous to the public health, safety and the environment
are often stored prior to their use in underground loca-tions.
These substances are potential sources of contamination of the
ground and the underlying aquifers and may pose other threats to public
health and the environment. In several cases, underground storage
has resulted in undetected and uncontrolled releases of hazardous
substances which have contaminated public drinking water supplies.
The Legislature recently adopted a measure to govern the construction,
maintenance, testing and use of underground tanks used for
the storage of hazardous substances. That measure further pro-vides
that a City may, by ordinance, assume responsibility for the implementation
of this program. The City Council of the City of Orange
desires that implementation should begin immediately within the
corporate limits of the City of Orange and that the program be administered
by the Orange Fire Department.Therefore,
pursuant to the procedures of California Government Code
Section 36937(b), the City Council does hereby enact this ordinance
as an emergency measure in order to protect the public health,
safety and welfare.ADOPTED
