ORD-53-83 UNIFIRM FIRE CODE CONCERNING STORAGE OF HAZARDOUS SUBSTANCES IN UNDERGROUND TANKSl-~~_______._.___.---,-________._________ORDINANCE NO. 53- 83 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 15.32 OF THE ORANGE MUNICIPAL CODE BY ADDING SECTION 80.113 TO THE 1979 EDI-TION OF THE UNIFORM FIRE CODE CONCERN-ING STORAGE OF HAZARDOUS SUBSTANCES IN UNDERGROUND TANKS. WHEREAS, the State of California recently enacted legislation for the inspection and regulation of the storage of hazardous sub-stances in underground tanks and piping; and WHEREAS, this legislation contains preemptive language restrict-ing cities from enacting local ordinances after January 1, 1984 in this field; and WHEREAS, the City Council desires that the Orange Fire Depart-ment continue inspection of underground flammable liquid storage tanks and further to inspect the underground storage facilities for hazardous substances in the interest of public health, safety and welfare by providing certain minimum standards as set forth in Assembly Bill No. 1362, enacted as Chapter 1046 of the 1983 statutes,and codified as Section 25150.1 and Sections 25280 through 25289 inclusive to the California Health and Safety Code;'and WHEREAS, it is the intention of the City Council to enact these minimum requirements as Section 80.113 of the 1979 Edition of the Uniform Fire Code.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I: Chapter 15. 32 of the Orange Municipal Code is hereby amended by adding Section 15.32.135 to read as follows:15.32. 135 Section 80.113 Storage of Hazardous Substances in Underground Tanks. Section 80.113 is hereby added to the Uniform Fire Code to read as follows:Section 80. 113 Storage of Hazardous Substances in Underground Tanks.The requirements of Assembly Bill No. 1362,enacted as Chapter 1046 of the 1983 Statutes, and codified as California Health and Safety Code Section 25150. 1 and Sections 25280 through 25289 inclusive are hereby adopted by reference as the standards of the City of Orange for the under-ground storage of hazardous substances." 11....-_.SECTION II:The reasons for the urgency of this ordinance are as follows:Substances hazardous to the public health, safety and the environment are often stored prior to their use in underground loca-tions. These substances are potential sources of contamination of the ground and the underlying aquifers and may pose other threats to public health and the environment. In several cases, underground storage has resulted in undetected and uncontrolled releases of hazardous substances which have contaminated public drinking water supplies. The Legislature recently adopted a measure to govern the construction, maintenance, testing and use of underground tanks used for the storage of hazardous substances. That measure further pro-vides that a City may, by ordinance, assume responsibility for the implementation of this program. The City Council of the City of Orange desires that implementation should begin immediately within the corporate limits of the City of Orange and that the program be administered by the Orange Fire Department.Therefore, pursuant to the procedures of California Government Code Section 36937(b), the City Council does hereby enact this ordinance as an emergency measure in order to protect the public health, safety and welfare.ADOPTED this 20th day 1983.Attest: Ci~ ogh~ Orange I, MARILYN J.
