THE CITY OF ORANGE AMENDING SECTION 5.32.
130 OF THE ORANGE MUNICIPAL CODE
CONCERNING POLICE INVESTIGATION FEES FOR
BUSINESS
PERMITS.WHEREAS, the City Council of the City of Orange
adopted Ordinance No. 33-83 to establish police
investigation fees for business
permits; and WHEREAS, the City Council of the City of
Orange finds that the Police Department spends numerous
hours conducting pOlice investigations prior to the issuance of
many business penni
ts; and WHEREAS, most of the businesses which
require pclice investigations pose pctentia1 law enforcement
problems; and WHEREAS, the City Council of the City of Orange
finds that those businesses which require police investigations
prior to the issuance of a business permit should pay a
substantial pcr-tion of the cost of such pOlice investigation rather
than have such pc1ice investigations subsidized by the
general tax
revenues; and WHEREAS, the City Council of the City of Orange
desires to clarify that the intent of Ordinance No. 33-83
was to provide for an extraordinary police investigation fee
for all SOlicitors and
vehicles for hire.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF ORANGE DOES
ORDAIN AS
FOLLOWS:SECTION I:Section 5.32.130 of the Orange Municipal
Code is hereby amended to
read as follows:5.32.130 Extraordinary Police
Investigation Fee. Unless an applicant is exempt by ordinance, statute or
law, in addition to a permit fee, and the amount set by the
state for processing fingerprints, there shall be an
extraordinary Police Investi-gation Fee in an amount established from time to
time by City Council Resolution for the
following business
permits:BUSINESS
PERMIT Amusement
Activities Amusement
circus
Coin Shop
Concealable Fire Arm Dealers
Dance Permit
Entertainment Premises
Escort Bureau Business
Massage Parlor
Pawnbroker
Secondhand Dealer
Solicitors
Tow Truck Business
Vehicles For Hire Service
In the event that the Chief of Police or his designee deter-
mines that the extraordinary police investigation fee is not
necessary in whole or in part to cover the cost of the extra-
ordinary police investigation fee, the Chief of Police or his
designee may waive the extraordinary police investigation fee or
a portion thereof.
SECTION II:
A summary of this Ordinance shall be published and a certi-
fied copy of the full text of this Ordinance shall be posted in
the Office of the City Clerk at least five (S) days prior to the
City Council meeting at which this Ordinance is to be adopted.
A summary of this Ordinance shall also be published once within
fifteen (IS) days after this Ordinance's passage in the Orange
City News, a newspaper of general circulation, published and
circulated in the City of Orange. The Clerk shall post in the
Office of the City Clerk a certified copy of the full text of
such adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in
accordance with Government Code Section 36933. This Ordinance
shall take effect thirty (30) days from and after the date of
its final passage.
