83 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING, FOR PURPOSES
OF CLARIFICATION ONLY, SECTION 17.72.060
OF THE ORANGE MUNICIPAL CODE
CONCERNING STORAGE IN FRONT
YARDS.WHEREAS, the intent of the existing Section 17.72.060
of the Orange Municipal Code is to prohibit the storing or
parking of objects in the front yard, except motor vehicles on a
drive-way to a garage;
and WHEREAS, the intent of the existing Section 17.72.060
is to also restrict trucks parking in a driveway to a height
limit of not more than five and one-half feet, yet not
to restrict recreational vehicles to this height
restriction;'and WHEREAS, the wording of the existing section is
subject to differing
interpretations;. and WHEREAS, the purpose of this amendment is to
revise Section 17.72.060 to insure that the original intent
concerning recrea-tional vehicles parking in a driveway is made
unmistakably clear.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN
AS FOLLOWS:
SECTION I:Amend Section 17.72.060 of Chapter 17.72 of
the Orange Municipal Code to read
as follows:17.72.060 Storage in Front Yards. It shall not
be permitted to store or park any object in the front yard,
except motor vehicles on a paved direct access way to enclosed
parking spaces.As to the parking of motor vehicles on a paved direct
access way,no motor truck, as defined in the California Vehicle
Code, shall exceed five and one-half feet (50 6")
in height. Recreational vehicles, as defined in the California Health and
Safety Code, may park on a paved direct access way to enclosed
parking spaces without regard to the height limitation imposed on motor
trucks. Any viola-tion of this section shall be punishable
as an
infraction.SECTION II:A summary of this Ordinance shall be published
and a certified copy of the full text of this Ordinance shall be
posted in the Office of the City Clerk at least five (5) days prior
to the City Council meeting at which this Ordinance is to be
adopted. A summary of this Ordinance shall also be published once
daysafterthis Ordinance's passage intheOrangeCity News,anewspaperofgeneral circulation,
published and circulated in the City of Orange. The City Clerk
shall post in the Office of the City
Clerk a certified copy of the full text of such adopted Ordinance
along with the names of those City Council members voting for and
against the Ordinance in accordance with Government Code Section 36933. This
Ordi-nance shall take effect thirty (30) days from
and after the date of its final passage.
