ORD-35-83 PERMIT FEES AND COSTS FOR PERMITS FOR FILM MAKING MOTION PICTURES TV PRODUCTIONS131 ORDINANCE NO. 35- 83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTIONS 5.45. 080 AND 5.45.090 OF THE ORANGE MUNICIPAL CODE REGARDING PERMIT FEES AND COSTS FOR PER-MITS FOR FILM MAKING, MOTION PICTURE AND TV PRODUCTIONS.WHEREAS, the City Plaza has been utilized for the production of motion pictures and TV shows such as Quincy and Cannonball Run; and WHEREAS, the City Plaza is a historical area and is so listed in the historical register; and WHEREAS, the City Council desires to allow the continued use of this area for media productions; and WHEREAS, the City Council desires to ensure that City Plaza is properly maintained and those media productions pay their fair share for the use of this historical area.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 5.45.080 of the Orange Municipal Code is hereby amended to read as follows:5.45.080 Permit Fees. A. Filing fee. Each application shall be accompanled by a non-refundable filing fee of one hundred dollars ($IOO).B. Permit fee. A non-refundable permit fee of two hundred and fifty dollars ($250) shall be paid by permittee for each day that activity is conducted. Such fee shall cover use of any property described in the application for permit for the purpose of photograph-ing and recording exterior and interior scenes, including the right to exhibit all or any part of such motion picture production through-out the world in any manner or medium. Such fee shall also cover the right to bring personnel and equipment, including props and temporary sets, onto the property described in the application for permit, and such personnel and all equipment belonging to said permittee shall be removed therefrom at the time the project is completed, or at such time as the City Manager deems 132 C. City Plaza Fee. In addition to the fees set forth in A and B above, a non-refundable permit fee of one thousand seven hundred and fifty dollars ($1,750) per day shall be paid by permittee for each day or, portion of a day that the activity is conducted at the City Plaza.SECTION II:Section 5.45.090 of the Orange Municipal Code is hereby amended to read as follows:5.45.090 Cost of Additional Cit Services. The cost of providing City serv~ces, ~nc ud~ng po ~ce, f~re, pub ~c works, and staff planning,shall be paid to the City by the applicant. The applicant shall pay in advance the estimated cost of City services as determined by the City Manager, but not to exceed ten thousand dollars ($10, 000).After completion of the permitted activity and upon approval of the City Manager, the amount paid in excess of the actual cost of pro-viding City services shall be returned to the permittee. In the event that the actual cost of City services exceed the amount paid in advance by the permittee, the permittee shall be informed of the amount owing and it shall be a debt to the City.SECTION III:The City Council hereby declares that it would have passed this Ordinance sentence by sentence, paragraph by paragraph, and section by section, and does hereby declare that the prov~s~ons of this Ordinance are severable and, if for any reason any sentence, para-graph, or section of this Ordinance shall be held invalid, such decision shall not affect the validity of the remaining parts of this Ordinance.SECTION IV:Any person violating any of the provisions of this Ordinance,punishment for which is not otherwise provided herein, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than $500 or by imprisonment in the county jail for a period of not more than six (6) months, or by both such fine and imprisonment.SECTION V:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange.The City Clerk shall post in the Office of the City Clerk a certi-fied copy of the full text of such adopted Ordinance along with the Ord. 35- 133names ofthose City Council members voting for and against the Ordin-ance in accordance with Government Code Section 36933.
