ORD-31-83 REGULATES SEVENTY-TWO HOUR PARKING89 ORDINANCE NO. 31- 83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING ORANGE MUNICIPAL CODE SECTION 10.34.070 REGULATING SEVENTY-TWO HOUR PARKING.WHEREAS, the intent of Orange Municipal Code Section 10.34. 070 was to require that vehicles not be parked or left standing on the public street for more than seventy-two (72) consecutive hours and that inoperative cars not remain on the streets for more than seventy-two (72) consecutive hours; and WHEREAS, some individuals have been known to push inoperative vehicles short distances in an attempt to circumvent the seventy-two 72) consecutive hour limitation; and WHEREAS, the City Council of the City of Orange desires to clarify that its intent is to require vehicles to either be driven at least one mile every seventy-two (72) hours or to be removed from the streets.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 10.34.070 of the Orange Municipal Code is hereby amended to read as follows:10. 34.070 Seventy-Two Hour Parking--Generally.No person who owns or has possession, custody or control of any vehicle shall park or leave standing such vehicle upon any street or alley for a period in excess of seventy-two (72) consecutive hours. Upon written notice of a violation of this section, the vehicle must be driven at least one (1) mile as evidenced by the cars odometer,or the vehicle must be removed from the street or alley.In the event a vehicle is not moved as required or removed upon written notice of a violation or in the event a vehicle is parked or left standing upon a street in excess of a con-secutive period of seventy-two hours, any member of the Police Department authorized by the Chief of Police may remove the vehicle from the street in the manner and subject to the requirements of California Vehicle Code Section 22650,et seq. ( L.. _._~u 90 SECTION II: If any provision or clause of this section or the application thereof to any person or circumstance is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other section provisions, clauses or applications thereof which can be implemented without the invalid provision, clause or application thereof, and to this end, the pro- visions and clauses of this section are declared to be severable. SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A sum- mary of this Ordinance shall also be published once within fifteen 15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
