ORDINANCE NO. 29-
83 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTIONS 5.16.
030 AND 5.16.140 OF CHAPTER 5.16 OF THE
ORANGE MUNICIPAL CODE CONCERNING INCREASE
IN TRANSIENT OCCUPANCY
TAX.WHEREAS, on July 19, 1983, the City Council of the City of
Orange approved an increase of the Transient Occupancy Tax from five
percent 5%) to eight percent (8%);
and WHEREAS, said increase was implemented by adoption of
Resolution No. 5950 on July 26, 1983;
and WHEREAS, the caption for Section 5.16.140 states that
Transient Occupancy Taxes collected shall be deposited into a Special
Fund;however, the text of that Section indicates a general use of
such funds;
and WHEREAS, it is the purpose of these amendments to Chapter 5.16
to state the correct tax percentage and to indicate that taxes
collected shall be deposited into the General
Fund.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
ORDAIN AS
FOLLOWS:SECTION
I:The first sentence of Orange Municipal Code Section 5.16.030
is hereby amended to read as
follows:5.16.030 Tax Imposed. For the privilege
of occupancy in any hotel, each transient is
subject to and shall pay a tax in the amount of
eight percent (8%) of the rent charged by the
operator."The remainder of Orange Municipal Code Section 5.16.030
shall remain
unchanged.SECTION
II:Delete Section 5.16.140 in its entirety and substitute
the following wording as Section 5.16.
140:5.16.140 Funds Deposited Into General
Fund.The tax collected by the City, imposed
under Section 5.16.130, shall be deposited into
the General Fund. Funds expended for
advertising and promotional purposes shall be paid
or transferred from the General

SECTION III:
A summary of this Ordinance shall be published and a certified
copy of the full text of this Ordinance shall be posted in the Office
of the City Clerk at least five (5) days prior to the City Council
meeting at which this Ordinance is to be adopted. A summary of this
Ordinance shall also be published once within fifteen (15) days after
this Ordinance's passage in the Orange City News, a newspaper of
general circulation, published and circulated in the City of Orange.
The Clerk Clerk shall post in the Office of the City Clerk a certified
copy of the full text of such adopted Ordinance along with the names
of those City Council members voting for and against the Ordinance in
accordance with Government Code Section 36933. This Ordinance shall
take effect thirty (30) days from and after the date of its final
passage.
