ORD-06-83 INCREASING THE SANITATION AND SEWAGE SYSTEM CHARGES FOR THE VARIOUS TYPES OF OCCUPANCIES1II1II ORDINANCE NO. 6-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE AMENDING SECTIONS 13.60.020, 13.60.030, AND 13.60.040 OF THE ORANGE MUNICIPAL CODE BY INCREASING THE SANI- TATION AND SEWAGE SYSTEM CHARGES FOR THE VARIOUS TYPES OF OCCUPANCIES AND SER- VICES MORE PARTICULARLY DESCRIBED IN THE AFOREMENTIONED SECTIONS. WHEREAS, THE City Council of the City of Orange has heretofore determined that the trash and rubbish contractor for the City has experienced cost increases which justify an increases of payment of compensation to the contractor for collecting trash and rubbish with- in the City of Orange; and WHEREAS, the aforementioned increase in payments to the con- tractor necessitates the increase of sanitation and sewage charges to the various types of occupancies and services more particularly described in Sections 13.60.020, 13.60.030 and 13.60.040 of the Orange Municipal Code: and WHEREAS, the City Council has determined that said increase of sanitation and sewage charges shall become effective on February 15, 1983, the date that this Urgency Ordinance shall be- come effective. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Sections 13.60.020, 13.60.030, and 13.60.040 of the Orange Municipal Code shall be amended as follows: 13.60.020 Charges in connection with sanitation and sewage system. The City furnishes to its residents services and facilities in connection with its sanitation and sewage system, and other services to provide a clean and healthful environment. For such services and facilities, the following charges are fixed to premises to which a sewer main is available: A. Single-family dwelling, $4.56 per month;B. Single-family dwelling units in any duplex, double house,and other buildings containing only single- family dwelling units,4. 56 per month;C. Apartment house, $4.56 per month for each apartment unit.When the Director of Public Works determines that it is not reasonably possible to place a trash bin at an active water meter service for a building generating trash in excess of five 45-gallon containers per week, the charge for each unit of such mUltiple-family building shall be an III""'"'"I!MI D. For each water closet in any hotel, motel, bungalow court, or auto,court, other than a water closet in any dwelling unit in Subsect1.0ns D and E hereof, the sum of $4.56 per month; G. Rooming house, $4.56 per month, together with $.95 per month for each rented room; H. Clubhouse equipped with sanitary plumbing facilities, $4.56 per month for one water closet, and $.95 per month for each additional water closet; I. For each office situated in any building other than an office building, $4.56 per month; J. Trailer camps or trailer parks, $4.56 per month for each trailer space; provided, that if any such trailer camp or trailer park disposes of its own trash, then the rate shall be only $.95 per month for each trailer space; K. For all other premises not specifically mentioned in this Section where such premises is occupied by one or more persons, or is used for commercial, professional, manufacturing, or processing purposes with sanitary plumbing facilitles, $4.56 per month for one vvater closet and $.95 per month for each additional water closet; L. For condominiums or townhouses with individual water meters and utilizing bin service, $.30 per month. 13.60.030 Trash disposal contractor--charges. For each residential unit, commercial unit, or industrial unit to which a sewer main is not available where such premises is occupied by one or more persons or is used for professional, commercial, manufacturing, or processing purposes, charges shall be $4.26 per month.SECTION II:This Urgency Ordinance shall become effective on February 15,1983, and shall remain in effect until May 1, 1983, or until Ordinance No. 7-83 becomes effective, whichever event occurs first.On the first happening of either of said events, this Urgency Ordinance shall become null and void without further action of the City Council.SECTION III The reasons for the urgency of this Ordinance are as follows:The City's trash contractor has experienced significant cost increases. These increases in costs necessitates an increase in the sum paid by the City to the trash contractor and, therefore, an increase in the sanitation charge paid by all property owners in the City.In order to cover these increased costs, the City and the City IS trash contractor agree that the contractor's increase in charges shall be effective as of February 8, 1983, and that certain sections of Title 13 of the Orange Municipal Code shall increase the sanitation and sewage charges which the City charges. It is impossible for the City Council to adopt a regular ordinance which could become effective at once; therefore, the necessity for this Urgency Ordinance. Unless an urgency Ordinance can become effective on February 15, 1983, it shall be necessary to increase the sanitation charge in a greater amount in order to permit the City's trash contractor to cover increased costs. An Ordinance enacted pursuant to the regularly established procedure would require five or six weeks from the day it was first introduced to become effective. THEREFORE, pursuant to the procedures of Section 36937 of the California Government Code, the City Council of the City of Orange hereby enacts this Ordinance as an urgency measure to become effective on February 15, 1983, in order to protect the public health, safety and welfare until the time the permanent ordinance becomes effective.
