ORD-31-82 THE PROHIBITION OF COMMERCIAL VEHICLES IN EXCESS OF 6,000 POUNDS ON S BATAVIA BETWEEN CHAPMAN AND LA VETAII.-. i-~1iL'H"JIiIiF-ORDINANCE NO. 31-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ORDAINING THE PROHIBITION OF COMMERCIAL VEHICLES IN EXCESS OF 6,000 POUNDS ON SOUTH BATAVIA STREET BETWEEN CHAPMAN AVENUE AND LA VETA AVENUE BY AMENDING CHAPTER 10.66 OF THE ORANGE MUNICIPAL CODE.WHEREAS, the City Council held a public hearing on September l4,1982, to consider the prohibition of motor vehicles of a gross weight of more than 6~, 000 pounds on Batavia Street between Chapman and La Veta Avenuesi and WHEREAS, at said hearing the testimony of concerned citizens and the City staff was taken; and WHEREAS, the City Council has determined that many trucks which use Batavia Street do so only as a convenient shortcut for the con-duct of business in other parts of the City; and WHEREAS, each school day several hundred children cross Batavia Street going to and from West Orange Elementary School; and WHEREAS, the City Council has determined that the continuing use by trucks of Batavia Street only for convenience presents an unreason-able and unnecessary risk of harm to school children and other pedestrians crossing said street; and WHEREAS, the Council desires that commercial vehicles in excess of 6,000 pounds shall be prohibited from using Batavia Street between Chapman and La Veta Avenues unless said vehicles are conducting busi-ness in the immediate area which necessitate the use of said street.NOW, rrHEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:Section I:Section 10.66.030 of the Orange Municipal Code is hereby amended to read as follows:10. 66.030 Prohibited Routes. Subject to the provisions', exceptions and limitations of Section 35703 of the Vehicle Code, no person shall operate any vehicle', as defined in Section 670 of the Vehicle Code, which has a gross weight of six thousand pounds or more upon or over the following streets when properly posted:A. Batavia Street from the intersection with Chapman Avenue to the intersection with La Veta Avenue. IIIII.\i: lml!rllilllll ;wlI-'section II:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5)days prior to the City Council meeting at which this Ordi-nance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance I s passage in the Orange City News', a newspaper of general circulation, published and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
