ORD-30-82 URGENCY MEASURE PROHIBITING COMMERCIAL VEHICLES IN EXCESS OF 6,000 POUNDS ON S BATAVIA BETWEEN CHAPMAN AND LA VETAIIIIII ORDINANCE NO. 30- 82 MJ INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE ORDAINING THE PROHIBITION OF COM-MERCIAL VEHICLES IN EXCESS OF 6,000 POUNDS ON SOUTH BATAVIA STREET BETWEEN CHAPMAN AVENUE AND LA VETA AVENUE BY AMENDING CHAPTER 10.66 OF THE ORANGE MUNICIPAL CODE.w~EREAS, the City Council held a public hearing on September 14,1982, to consider the prohibition of motor vehicles of a gross weight of more than 6,000 pounds on Batavia Street between Chapman and La Veta Avenues; and wEEREAS, at said hearing the testimony of concerned citizens and the city Staff was takeni and WHEREAS, the City Council determined that the continuing use by said vehicles on Batavia Street presents an unreasonable risk of harm to children walking to and from West Orange Elementary School and to other persons crossing that streeti and viliEREAS, the City Council desires that the use of Batavia Street between Chapman and La Veta Avenues by comuercial vehicles which have a gross weight of 6.,000 pounds or more shall cease irrunediately.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:Section I:Section 10.66.030 of the Orange Municipal Code is hereby amended to read as follows:10.66.030 Prohibited Routes. Subject to the provisions, exceptions and limitations of Section 35703 of the Vehicle Code, no person shall operate any vehicle', as defined in Section 670 of the Vehicle Code, which has a gross weight of six thousand pounds or more upon or over the following streets when properly posted:A. Batavia Street from the intersection with Chapman Avenue to the intersection with La Veta Avenue.Section II:The reason for the urgency of this Ordinance is as follows:Schools have opened for the fall term. Each school day several hundred children cross Batavia Street going to and from West Orange Elementary School. It has been determined that many trucks use Batavia Street as a convenient shortcut to businesses in other parts of the City. This Ordinance will prohibit those trucks which are using Batavia Street for the purpose of convenience only,but will not adversely affect such vehicles making deliveries in the ~mediate proximity of said street. Truck traffic will be substantially reduced, thereby lessening the risk of harm to pedestrians who cross Batavia Street. The City Council hereby enacts this interim Ordinance as an urgency measure to protect the public health, safety and welfare of its citizens from the immediate risk of Section III: This Urgency Ordinance shall be null and void and without further force and effect on November 1, 1982, or upon the effective date of Ordinance No. 31-82, whichever event occurs first.ADOPTED this 21st ATTEST:4w!~~'~City Clerk of th cit of Orange STATE OF CALIFORNIA )COUNTY OF ORllliGE ) ss CITY OF ORANGE )I, MARILTI~ J.
