B)OF THE PRESENT ORANGE MUNICIPAL CODE
AND COMPARABLE SECTION 17.92.140(B) OF
THE PROPOSED REVISION OF THE ORANGE
MUNICIPAL CODE TO INCREASE THE PERIOD OF
VALIDATION FROM EIGHTEEI~ MONTHS (1 1/2 YEARS)
TO TWENTY-FOUR MONTHS (2 YEARS)
FOR APPROVED CONDITIONAL USE PERMITS
AND VARIANCES.
AMENDMENT 3-82
CITY OF ORANGE WHEREAS, the Planning Commission heretofore
has held a duly advertised pUblic hearing on
the hereinafter described amendment to the Orange Municipal Code
and has recommended to the City Council, by ResolutionNo. PC-
36-82, approval thereof; and WHEREAS, Section 17.86.170(B) of the Orange Municipal Code and Section 17.92.140(B)
of the proposed revision to the Orange Municipal
Code are both entitled, "Revocation of Variances and Conditional Use
Permits"
and now read as follows:B. Every variance
or conditional use permit issued after the effective
date of this section shall become void unless
the use or construction has begun within eighteen
months after the date the variance or
conditional use permit was approved.The Planning
Commission may, upon written request prior to expiration, extend
the length of time of an approved
variance or conditional use permit
upon presentation of extenuating circumstances."WHEREAS, the words "eighteen
months" is proposed to be changed in both the OrangeMunicipalCodeandproposedzoningordinancetoread "
twenty-four months (2 years)"; and WHEREAS, the State
Legislature passed AB 612 amending Section 66452.6 of the Government Code,
extending the life of a tentative map from eighteen months to
two years. Since many conditional use permits and variances are processedtogetherforaproject, it is felt that the time period for
these approvals should have
the same period of validation; and WHEREAS, the eighteen months allowed
by Section 17.86.170(B)of the Municipal Code and Section 17.92.140(B) of the proposed zoning ordinance doesnotprovideapplicantswithsufficienttimetoutilizethevariances
or conditional use permits granted; and WHEREAS, the twenty-
four months would be a more reasonable period of timethaneighteenmonthsforapplicantstoutilizetheirvariancesa~
d conditional use permits as well as considerably
reduce City administrative time now

NOW, THER~FORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
ORDAIN AS FOLLOWS:
SECTION I:
section 1 7 .. 86..1 7 0 ( B) of the present Or ange Munic ipal Code
shall be amend ed to read as follows:
B. Every variance or conditional use permit issued

Orange Municipal code shall be amended to read as

SECTION II:This ordinance shall be published once within
fifteen (15)days after its passage in the Orange City News, a
newspaper of general circulation, published and circulated in the
City of Orange, and shall take effect thirty (30) days from and
after the date of its final
