ORD-29-81 REQUIRES A CONDITIONAL USE PERMIT TO OPERATE CERTAIN AMUSEMENT BUSINESSES IN C-2 DISTRICTSORDINANCE NO. 29- 81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SUBSECTION liE" OF SECTION 17.46.020 TO REQUIRE A CONDITIONAL USE PERMIT TO OPERATE CER-TAIN AMUSEMENT BUSINESSES IN C- 2 DIS-TRICTS.AMENDMENT 5 -81 CITY OF ORANGE WHEREAS, the Planning Commission heretofore has heldadulyadvertisedpublichearingonthehereinafter described amendment to the Orange Municipal Code and has recommended to the City Council approval thereof; and WHEREAS, a nine member committee consisting of three members representing the coin-operated amusement device industry, three members of the community, and three members of the City staff, has conducted investigations into coin- operated amusement devices; and WHEREAS, said committee and the City Council find that there are potential problems associated with large numbers of amusement devices in one establishment; and WHEREAS, the City Council of the City of Orange finds that more precise criteria are necessary in order to establish when a condi-tional use permit is required for a business which maintains amuse-ment devices; and WHEREAS, the City Council finds that problems regarding minors spending lunch money or excess amounts of money on amusement devices are matters that are better left to parental control; and WHEREAS, the City Council of the City of Orange finds that fifteen (15) amusement devices in a business, regardless of the type of business, has such an impactonthesurroundingcommunitythataconditionalusepermit should be required; and WHEREAS, the City Council of the City of Orange finds that three (3) or less machines in a business usually do not have such an impact on the surrounding community.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Subsection liE" of Section 17.46.020 of the Orange Municipal Code is hereby amended to read as follows:E. Establishments where customer use or operation of coin-operated pinball machines or similaramusementdevicesareproposedunderanyone ADOPTED this 22nd day of September 1981. 1. The primary business conducted at the premises at which the machines are located is the use and operation of such machines. 2. Regardless of the type of business or businesses con- ducted at the premises, fifteen (15) or more such machines or de- vices are located. 3. In any business premises where four (4) or more such machines or devices exist adjacent to or in close proximity to each other and the building floor area occupied by these machines or devices exceed five percent (5%) of the total floor area accessible to the general public. Because of the police problems relating to said use, a condi- tional use pennit shall not be issued unless a detennination can be reasonably made that use is compatible with land uses in the sur- rounding area. A conditional use permit granted for said use may be subject to any or all of the following conditions: a. Regulation of hours of operation. b. Adequate area lighting. c. provision for private security guard. d. Review by City of conditional use permit periodically to assure that no increase in police services are required. e. Assurance of adequate visibility of all amusement devices. f. Such other conditions as the Planning Commission shall deem necessary to protect the public health, safety and welfare. SECTION II: This Ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
