ORD-26-81 URGENCY MEASURE AMENDING THE OMC BY ADDING CH 17.69 A SINGLE STORY OVERLAY DISTRICTORDINANCE NO. 26- 81 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE AMENDING THE ORANGE MUNICIPAL CODE BY ADDING CHAPTER 17.69, A SINGLE- STORY OVERLAY DISTRICT.WHEREAS, after extensive public hearings and study sessions,the Planning Commission has recommended to the City Council for approval a revised comprehensive zoning code for 'the City of Orange; and WHEREAS, said proposed zoning code is now beingreviewedbytheCity Council; and WHEREAS, included in said zoning code is a new zoning classi-fication called the Single-Story Overlay District, denoted by the suffix itA"; and Chapter 17.69 WHEREAS, the purpose of the new classification is to limit development in any district where the suffix "A" is applied to single storYi and WHEREAS, the City Council favors the adoption of an ordinance which will provide an opportunity to impose a single-story restriction in those portions of the City where previous develop-ment and environmental conditions would deem said restriction appropriate; and WHEREAS, the City Council has determined that the public interest require the immediate adoption of that portion of said proposed code concerning the Single-Story Overlay District.NOW, THEREFORE, THE CITY COUNCIL HEREBY ORDAINS AS FOLLOWS:SECTION I:Chapter 17.69 is hereby added to the Orange Municipal Code to read as follows: A SINGLE-STORY OVERLAY DISTRICT Sections: 17.69.010 17.69. 090 Intent and Purpose Development Standards 17.69.010 Intent andPurpose. A. The intent and purpose of the A single- story overlay district is to limit development within such district to a single story.B. In any district where the district symbol is followed by,as part of such symbol, the letter "A", development shall be 17.69.090 Development Standards. A. The height limit forallbuildingsinthesingle-story overlay district shall beonestoryortwentyfeet, whichever is less.B. All other development standards applicable to theunder-lying district and not in conflict with this section shallapplytoanydevelopmentinsuch district.SECTION II:The facts constituting the urgency justifying theenactmentofthisordinanceareas follows:In February, 1979, the City Council approved TentativeTractNo. 10653, subject to the condition that no final map shallbeapproveduntilthesubjectpropertywasrezonedinamanner to assure that houses constructed in the tract would besingle-story.The City Council imposed said condition afterpublichearingsandmakingthedeterminationthatthenatureofprevioussingle-story development in the surroundingareaandotherenvironmentalconsiderationsindicatedthatthepublicinterestwouldbebestservedthereby. Thedeveloperhasrecentlyrequestedthathebegrantedafinalmapfor Tract No. 10653.The City Council is now in the process of reviewing the proposed revised comprehensive zoning code whichprovidesforasingle-story overlay district. The CityCouncilhasnotcompleteditsreviewofsaidcode. It may beseveralmonthsbeforethereviewandadoptionprocessiscompleted. In the meantime, the developer cannot obtain his final map because of the condition restricting his developmenttosingle-story houses. Therefore,the City Council has determined that itisinthebestinterestsofthedeveloperandthepublicthattheSingle-Story Overlay District be adopted immediately. In so doing the developer can satisfy the condition and obtainhisfinalmapandthepublicshallbeassuredthat only single-story houses shall be con-structedin said tract.
