ORD-23-81 APPROVING THE RECLASSIFICATION OF PROPERTY SITUATED ON THE SOUTH SIDE OF CHAPMAN AVENUE WEST OF NEWPORT BOULEVARDZONE CHANGE 937 ORDINANCE NO. 23- 81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORA NGE AMENDING SECTION 17.06. 020 OF THE O~~GE MUNICIPAL CODE AND APPROVING THE RECLASSIFICATION OF PROPERTY SITUATED ON THE SOUTH SIDE OF CHAPMAN AVENUE WEST OF NEWPORT BOULEVARD.PATS CHECK DEVELOPMENT COMPANY RECITALS:After report thereon by the Planning Comro.ission and after due public hearings as required by law, and after finding the facts as shown by Resolution No. 5361 adopted by the City Council,the City Council of the City of Orange has concluded that the following amendment to Section 17.06.020 of the Orange Municipal Code should be adopted:NOV.], THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 17.06.020 of the Orange Municipal Code, by which there is classified as A-l District, that certain real property in the City of Orange, County of Orange, State of California, hereinafter described, is amended in order to change the zoning classification of said property to the O-P District.Said property is described as follows:Exhibit 1 That portion of the land allotted to Nievas Lopez de Peralta,in Decree of Partition of the Rancho Santiago de Santa Ana,recorded in book liB" of Judgments of the 17th Judicial District Court of California in the County of Orange, State of California, described as follows:Beginning at the most Easterly corner of Parcel 1 of the land described in the deed to John R. Kennedy and wife, recorded October 5, 1945 in book 1357, page 301 of Official Records,said point being onthe centerline of a county road, known as County Park Road, thence North 680 23' 00" West 435.59 feet along said centerline to the true point of beinning; thence continuing North 680 231 00" West 288.65 feet along said centerline; thence South 80 43' 00" West 426. 20 feet; thence North 860 17' 00" East 172.85 feet; thence North 280 18' 00" East 340 feet, more or less, to the true point of beginning.Except therefrom that portion lying Northeasterly of the South-westerly line of the 100.00 foot wide strip of land described as follows:Beginning at the centerline intersection of Chapman Avenue and Newport Avenue as said center line is shown in Orange County Surveyor's Alignment Book A/4-9, page 116 on file in the office of the Orange County centerline of Chapman Avenue South 890 58' 5211 East, 1072.48 feet to the beginning of a curve concave Northwesterly having a radius of 1200.00 feet; thence, Northeasterly 1140.72 feet along said curve through a central angle of 540 27' 55";thence North 360 43' 13" East 1525.62 feet to the beginning of a curve concave, Southeasterly having a radius of 1200.00 feet;thence Northeasterly 585.23 feet along said curve through a central angle of 270 56' 33u: thence North 640 39' 46" East 318. 04 feet to the beginning 'of a curve concave, Northwesterly having a radius of 1000.00 feeti thence Northeasterly 338.03 feet along said curve through a central angle of 220 13' 57";thence North 420 25' 49" East 227.11 feet to the beginning of a curve concave Southeasterly having a radius of 1000.00 feet;thence Northeasterl~ 760.90 feet along said curve through a central angle of 43 35' 47"; thence north 860 01' 36" East 1037. 87 feet to the beginning of a curve concave Southerly having a radius of 1200.00 feet; thence Easterly 184.16 feet along said curve through a central angle of 80 47' 35" i thence Sout. h 850 10' 49" East 475.87 feet to the beginning of curve concave Southwesterly having a radius of 1200.00 feeti thence Southeasterly 307.20 feet along said curve through a central angle of 240 13' 01"; thence South 600 57' 48" East 177.55 feet.Excepting therefrom all oil, gas, minerals and hydrocarbon substances in and under said land, but without the right of surface entry, as reserved in deed recorded in book 1533,page 526, of Official Records of said Orange County.SECTION II:This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general cir-culation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.ADOPTED this 25th day of August, 1981.ATTEST: STATE OF CALIFORNIA COUNTY OF ORANGE ss CITY OF ORANGE I, MARILYN J.
