THE CITY OF ORANGE AMENDING SECTION 9.20.
010 OF THE ORANGE MUNICIPAL CODE TO
ALLOvl CHARAcrER READING BY HANDWRITING
ANALYSIS.WHEREAS, the Department of Community Services
desires to conduct a class in handwriting analysis which does
not involve fortunetellingi
and WHEREAS, the United States Supreme Court stated
in United States v. Mara, 410 U.S. 19, "Handwriting,
like speech, is repeatedly shown to the public and then is
no more expectation of privacy in the physical
characteristic of a person's script than there is in the tone of his voice
i"
and WHEREAS, scientific studies, (such as "A
Validation Study of Personality Assessment Through Graphoanalysis"
by R. C. Naegler, Ed. D., Associate Professor of Psychology
and Education, Druay College), indicate that handwriting
analysis can be utilized to help ascertain personality
characteristicsi
and WHEREAS, Section 9.20.010 of the Orange Municipal
Code currently states that one shall not practice, exhibit
or teach character reading by handwriting
analysis.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN AS
FOLLOWS:SEcrION
I:Section 9.20.010 of the Orange Municipal Code is
hereby amended to read as
follows:9.20.010 Fortunetelling Unlawful. No person
shall carryon, practice, exhibit or teach the business
or art of astrology, palmistry, phrenology,
life-reading,fortunetelling, cartomancy, clairvoyance,
crystal gazing,mediumship, spirit photography, spirit
writing, spirit voices, spirit materialization,
etherealization, prophecy,augury, divination, magic
necromancy, fortunetelling by handwriting analysis, or other similar business
or art,and demand or receive directly or indirectly a
fee., gift,donation or reward therefor. (Prior Code
Section 4210).
SEcrION II:This ordinance shall be published once fifteen (
15) days after its passage in the Orange City News, a newspaper
circulation, Published and circulated in the City of Orange,
and shall take effect thirty (30) days from and after the date
of its final passage.
