Box 449, Orange, California 92666, IA RI L r!!.2,:,,__'J.!:;.t:lE.fC:~L_C~T.X._C~f':~,'" ORDINANCE NO. 67- 79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE AMENDING SECTION 7901 OF THE ORANGE MUNICIPAL CODE AND INCREASING THE SANITATION AND SEWAGE SYSTEM CHARGES TO THE VARIOUS TYPES OF OCCUPANCIES MORE PARTICULARLY DESCRIBED IN THE AFOREMENTIONED SECTION 7901.WHEREAS, the City Council of the City of Orange has heretofore determined that the trash and rubbish contractor for the City has experienced cost increases which justify an increase of payment of compensation to the contractor for collecting trash and rubbish within the City of Orange; and WHEREAS, the City Council has heretofore determined that such rate increase should be granted subject to certain conditions effective January 1, 1980, effective date of this urgency ordinance; and WHEREAS, the aforementioned increase in payments to the contractor necessitates the increase of sanitation and sewage charges to the various types of occupancies more particularly described in Section 7901 of the Orange Municipal Code.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 7901 of the Orange Municipal Code shall be amended as follows:Section 7901. Charges in Connection with Sanitation and Sewage System The City furnishes to its residents services and facilities in connection with its sanitation and sewage system, and other services to provide a clean and healthful environment. For such services and facilities, the following charges are hereby fixed to premises to which a sewer main is available:a)Single Family Dwelling, $2.62 per month;Single Family Dwelling Units in a~y duplex, double ,house, and other building containl.ng only single faml. 1y dwelling units, $2.62 per month;Apartment house, $2.62 per month for each apartment;Hotel, motel, bungalow court, or auto court, $2. 62 for each dwelling unit therein with cooking facilities;Hotel, motel, bungalow court, or auto court" 86~ per , ,month for each dwelling unit with private tOl.let faci11tl. eS only, other than a dwelling unit described in subsection d) above;For each water closet in any hotel, motel, bungalow court, or auto court other than a water closet in any dwelling unit in subsections (d) and (e) hereof, the sum of $2.62 per month; b) c) d) e) g) h) i) Rooming house, $2.62 per month, together with 86~ permonthforeachrentedroom; Club house, equipped with sanitary plumbing facilities, 2.62 per month for one water closet, and 86~ per month for each additional water closet; For each office situated in any bUilding other than an office building, $2.62 per month; Trailer camps or trailer parks, $2.62 per month for each trailer space; provided that if any such trailer camp or trailer park disposes of its own trash, then the rate shall be only 86~ per month for each trailer space; For all other premises not specifically mentioned herein where such premises is occupied by one or more persons, or is used for commercial, professional, manufacturing, or processing purposes with sanitary plumbing facilities, 2.62 per month for one water closet and 86~ per month for each additional water closet. This increase in labor costs necessitates an increase in the sum paid by the City to the trash contractor and, therefore, an increase in the sanitation charge paid by all property owners in the City. In order to cover increased labor costs, the City and the City's trash contractor agreed that any increase in charges should be effective as of January 1, 1980. However, due to length of time necessary to analyze the financial data submitted by the trash contractor and due to length of time to reach agreement on a recommended increase, it was impossible for the City to present a regular ordinance to be effective on January I, 1980; therefore, the necessity of this urgency ordinance.iM" I A" ii Q I ip Unless an urgency ordinance can become effective on January 1, 1980, it shall be necessary to increase the sanitation charge in a greater amount in order to permit the City's trash contractor to cover increased labor costs. An ordinance enacted pursuant to the regularly established procedure would require five or six weeks from the day it was first introduced to become effective.
