OF THE CITY COUNCIL OF THE CITY OF ORANGE
AMENDING SECTION 9250.1 (B) (1) OF THE ORANGE
MUNICIPAL CODE RELATING TO THE ELIMINATION OF
THE MINIMUM SITE SIZE REQUIREMENT FOR A
PLANNED UNIT DEVELOPMENT.Amendment 7-

OF ORANGE WHEREAS,
the City Council concurs with the Staff's recommendation and
determines that the four acre minimum lot size requirement for
Planned unit Development is unnecessary from an economic or design
standpoint; and WHEREAS,
the Planning Commission has traditionally granted variances
to this provision in the Code, calling into question the
validity of its continued application, and the City Council has
generally concurred in most of these variance approvals; and WHEREAS,
the rationale of a four acre minimum lot size requirement
for a Planned Unit Development, as necessary to achieve
a high standard of development, is not borne out by the experience
of those granted variances in the past; and WHEREAS,
the City Council concurs in the finding of the Planning
Commission that the four acre minimum lot size is unnecessary
because the remaining vacant parcels which are less
than four acres in size are appropriate for Planned Unit Development
proposals; and WHEREAS,
controls on development design and quality would be retained
through the requirement of a conditional use permit as delineated
in Section 9250.NOW,
THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN
AS FOLLOWS:SECTION
I:Section
9250.1 (B) (1) of the Orange Municipal Code is hereby
amended to read as follows:Section
9250.1 (B) (1)DELETE)
SECTION
II:This
ordinance shall be published once within fifteen (15)days
after its passage in the Orange City News, a newspaper of general
circulation, published and circulated in the City of Orange,
and shall take effect thirty (30) days from and after the
date of its final passage.ADOPTED
