TO THE ORANGE MUNICIPAL CODE RELATING TO REGULATING COIN SHOPS.WHEREAS, the City Council of the City of Orange is of the opinion that bona fide coin shops are a specialized enterprise and should be separated from other secondhand enterprisesl and WHEREAS, the City Council of the City of Orange is of the opinion that the value of collected coins is derived from their age, rareness, condition, mineral content, and historical associations as differentiated from coins used as money and legal tender and from other common secondhand merchandise land WHEREAS, the City Council and the Police Department of the City of Orange have determined that in regulating coin shops only, the following regulations are germane to that type of business. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Sections 6355 through 6355.6 are hereby added to the Orange Municipal Code and shall read as follows:Section 6355 Definition As used in this chapter, "COIN SHOP" means a business where coins or currency are bought, sold, traded, pawned,auctioned, or accepted for sale on consignment at a price above the face value of such coins or currency upon the basis, express or implied, that the value above the face value is derived from the age, rareness, condition, mineral content, or historical associations of the coins or currency.Except for coins or currency, "COIN SHOP" shall not inc1 ude a shop where secondhand merchandise, including but not limited to jewelery or metals, is bought, sold, traded,pawned, auctioned, or accepted for sale on consignment.Shops which buy, sell, trade, pawn, auction, or accept for sale on consignment coins or currency at a price above the face value of such coin or currency and where secondhand merchandise, other than coins or currency, is bought, sold,traded, pawned, auctioned, or accepted for sale on consignment shall comply with Sections 6450 et seq. of the Orange Municipal Code as to such other secondhand merchandise.Section 6355.1 Permi t Required No person shall conduct business as a coin shop within the City without first obtaining a proper permit therefor,as herein provided. section 6355.2 Application Application for a coin shop permit shall be made to the Business Services Coordinator who shall refer all such applications to the Chief of Police for an investigation. Section 6355.3 Police Investigation The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. Applicant shall pay the amount set by the state for processing the fingerprints. The Chief of Police shall cause an investigation of each applicant to be made to determine if such applicant has committed an act that if done by a permittee would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of any crime that has a substantial relationship to the permitted business. Section 6355.4 Buyinq, Reporting, and Holding Requirements a) The holder of a coin shop permit shall report all coins or currency which he has purchased, taken in trade, taken in pawn, accepted for auction, or accepted for sale on consignment to the Chief of Police of the City of Orange, not later than twelve noon of the day following the acquisition of such coins or currency. b) The holder of a coin shop permit shall be required to comply in accordance with Orange Municipal Code Sections 6450.4 through and including 6450.10 on all identifiable, including but not limited to, serialized items, rare coins that are one of a kind or could be readily identified, proof sets, coin sets in book, folder or 2x2's, silver or gold bars with distinctive casting marks, and any items that are included with such purchases including, but not limited to, any common silver coins which he has purchased, taken in trade, taken in pawn, accepted for auction, or accepted for sale on consignment. c) The holder of a coin shop permit shall not be required to hold common silver coins or other unidentifiable items when that is the only type property purchased, for the thirty days as required by Orange Municipal Code Section 6450.9. The holder of a coin shop permit, where the thirty day hold is not required, shall mark at the bottom left the words, "Exempt from Hold Period,' on the reports required in accordance with Orange Municipal Code Sections 6450.6, 6450.7, 6450.8 and 6450.9. Section 6355.5 Minor customer No person conducting a business as a coin shop shall buy, trade, accept for consignment or auction, or loan money for coins or currency at a price above the face value of such coins or currency from any person who is under sixteen years of age, unless said person is accompanied by his parent, guardian or other person in lawful custody of the person who is under sixteen years of age. The person conducting a coin shop shall obtain the written permission, 2- under penalty of perjury, from the parent, guardian or other person in lawful custody of the person who is under sixteen years of age before the person conducting a business shall buy, trade, accept for consignment or auction, or loan money for coins or currency at a price above the face value of such coins or currency from any person who is under sixteen years of age. A copy of the written permission shall be submitted to the Chief of Police of the City of Orange, not later than twelve noon of the day following the acquisition of such coins or currency. Section 6355.6 Fee The permit fee shall be five dollars ($5.00) per applicant. SECTION II: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
