CITY CI.ERK ORDINANCE NO. 56- 79 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE ORDAINING THAT NO APPLICATIONS FOR THE CONVERSION OF MULTIPLE DWELLING UNITS TO RESIDENTIAL CONDOMINIUMS SHALL BE ACCEPTED FOR PROCESSING BY THE CITY OF ORANGE FOR A PERIOD OF NINETY DAYS.WHEREAS, California Government Code Section 65858 provides that a legislative body to protect the public safety, health and welfare may adopt as an urgency measure an interim ordinance, to prohibit any uses which may be in conflict with a contemplated zoning proposal which the legislative body, Planning Commission or the Planning Department is considering or studying or intends to study within a reasonable time; and WHEREAS, the City Council desires to examine the adequacy of present City policies, practices, standards and local laws as they may concern the conversion of existing multiple dwellings into condominiums and to determine if said policies, practices,standards and local laws require amendment or modification; and WHEREAS, the City Council has several particular concerns regarding condominium conversions which bear directly on the public safety, health and welfare. These concerns include, but are not necessarily limited to, the following:1. The possible significance and impact of condominium conversions on the City's existing rental stock.2. The displacement of elderly, handicapped and the lower to moderate income persons from multiple dwellings to be converted,and any problems these persons may encounter in relocation.3. The standards to be applied to conversion projects, inc 1 uding safety and sanitation requirements, sound attenuation,privacy, parking, etc.4. The City I s system of processing conversion applications.WHEREAS, the City Council previously requested reports on various aspects of the conversion of multiple dwellings into condominiums in the City of Orange from the Housing Element Review Committee and City Staff and these reports are now being received; and WHEREAS, the City Council will require approximately ninety days to complete its study; to determine if present policies,practices, standards <!.nd local laws are adequate to protect the public safety, health and welfare; and, if not, to enact measures that shall provide such protection.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS SECTION I: The City Council hereby ordains that no applications sha 11 accepted for the conversion to residential condominium units any multiple dwelling units, whether they are presently existing or for which construction has begun for a period of ninety days from the date of adoption of this interim ordinance or until such earlier date as the City Council may subsequently ordain. SECTION II: The City Council hereby directs the Director of Planning and Development Services to hold up any consideration of any conversion applications not now pending before City Council. SECTION III: The facts constituting the urgency justifying the enactment of this ordinance are as follows: The City of orange has been processing applications for the conversion of multiple dwelling units to condominiums with ever- increasing frequency. The City Council is not now fully aware of the significance of the impact of said conversions upon the public safety, health and welfare and, in particular, on the housing needs of the community. The City Council desires to examine the adequacy of present City policies, practices, standards and local laws and to study reports presented by Staff and the Housing Element Review Committee. Further, the City Council desires sufficient time to enact any measures which may be necessary to protect the public safety, health and welfare, and to solve these housing needs. THEREFORE, pursuant to the provisions of Section 65858 of the California Government Code and in order to protect the public safety, health and welfare, the City hereby adopts this interim ordinance as an urgency measure which shall be effective for a period of ninety days or for such period less than ninety days as the City Council may subsequently determine.
