CI~~ ERK AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE REGULATING THE PRACTICE OF HYPNOSIS AND THE TEACHING OF SELF-HYPNOSIS AND PROVIDING FOR THE LICENSING OF SUCH PRACTITIONERS. THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Section 4210.1 of the Orange Municipal Code shall be amended in its entirety to read as follows: section 4210.1 Hypnotism, Practice and Teaching No person shall carryon, or practice, exhibit or teach the business or the art or practice of hypnosis, nor teach self-hypnosis to any person undergoing a course of treatment or program of self-improvement except under one of the following conditions:a) The hypnosis or teaching of self- hypnosis is done pursuant to the provisions of and for the purposes set forth in Section 2908 of the Business and Professions Code of the State of California, and if performed by a person licensed to practice medicine, dentistry or psychology in the State of California, or by a person licensed to practice in the State of California as a clinical social worker or as a marriage and family counselor.b) Nothing in this section shall prohibit a peace officer,as defined in Chapter 4.5 (commencing with Section 830)of Title 3 of Part 2 of the California Penal Code, from utilizing hypnosis in the fulfillment of his or her duties as a peace officer.SECTION II:If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence,clause and phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.SECTION III:Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof,shall be subject to a fine not exceeding Five Hundred Dollars 500.00), or by imprisonment for not more than six (6) months,or by both such SECTION IV: This ordinance shall be published once within fifteen (15) days afte: its p,;ssage in, the orange, Ci ty News, a newspaper of general cl.rcu1atl.on, pub1l.shed and cl.rcu1ated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage. 20th day of NovemberADOPTEDthis 1979.
