NO. 52-79
AN INTERIM ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE
AMENDING SECTION 9l08(f) OF THE ORANGE MUNICIPAL
CODE BY THE ADDITION OF A REQUIREMENT FOR A
CONDITIONAL USE PERMIT FOR THE SALE OR DELIVERY
OF ALCOHOLIC BEVERAGES AS AN ACCESSORY USE TO
THE OPERATION OF AN AUTOMOBILE SERVICE STATION.
WHEREAS, there is an application now before the Alcoholic
Beverage Control for a 20 beer and wine sales license to be
located at 480 North Glassel1 Street; and
WHEREAS, if approved, said beer and wine sales would be made
as an adjunct to gasoline and petroleum products salesl and
WHEREAS, the Orange Police Department has reported this area
to be one with serious law enforcement problems; and
WHEREAS, the City Council has determined that there is
presently a great concentration of liquor stores in said area;
and
WHEREAS, the City Council desires to protest the issue of
said 1 icense; and
WHEREAS, the City Council wants the matter of any application
for the sale of liquor on the same premises as a service station
to be subject to close review and a conditional use permit; and
WHEREAS, no such conditional use permit shall be issued
unless there shall be a fully-noticed public hearing and
the applicant can comply with reasonable conditions imposed to
protect the health, safety and welfare of the citizens of
Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS
FOLLOWS:SECTION
I:The following is hereby added to section 9l08(f) of
the Orange Municipal Code, and shall read as
follows:Section 9108 (
f)13. When the sale or delivery of any alcoholic beverage
is proposed as an accessory use to the operation of
an automobile service
station.SECTION
II:The reasons for the urgency of this ordinance are as
follows:Because of problems of law enforcement, the City Council
has determined that each application for the sale of liquor as
anacc,,:ssory use to the operation of a service, station, ,shall,
be SUbJect to a conditional use permit. The Cl.ty Councl.1 desl.
that the application for such a license at 480 North G1asse11
street should also be subject to the conditional use permit
process, including a fully-noticed public hearing. An
urgency ordinance is hereby enacted because a regular ordinance
would require at least thirty (30) days before it could become
effective.Said application is now before Alcoholic Beverage Control.
The City now has less than thirty (30) days in which to protest
said
application.THEREFORE, pursuant to the procedures of Section 36937
of the Government Code, the City Council of the City of
Orange hereby enacts this ordinance as an urgency measure in order
to protect the public health, safety and welfare until such time
as a permanent ordinance can be
enacted.ADOPTED this 18th day of September,
