(,(';:$n,. .,;"..:." ,I <"'/ tL5'1' 110 l;J.'<:I -;;2t-"-:; If!:;AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 2201.6 OF THE ORANGE MUNICIPAL CODE, CREATING THE POSITION OF CHIEF CLERK AND PROVIDING FOR THE APPOINTMENT THEREOF AND SETTING FORTH GENERAL DUTIES AND RESPONSIBILITiES FOR SAID POSITION.WHEREAS, the incumbent Chief Clerk, Charlotte M. Johnston,has retired; and WHEREAS, the City Council authorized a special study of the City Clerk/ Chief Clerk's office and operation; and WHEREAS, said study indicated that the Chief Clerk's position should be appointed by the City Council and be responsible to both the City Manager and the City Council.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I: Section 2201. 6 of the Orange Municipal Code is hereby amended to read as follows:Section 2201. 6 Department of Records The Department of Records shall consist of a City Clerk and a Chief Clerk.Section 2201. 6.1 City Clerk 1) The City Clerk shall perform those functions required by State Law.2) The City Clerk shall receive as compensation the sum of 365.00 per month.Section 2201. 6.2 Chief Clerk The Chief Clerk shall be appointed by the City Council and serve at its pleasure and be responsible to both the City Manager and the City Council in performing the administrative duties of that office.1) Duties: The Chief Clerk shall receive documents addressed to the City Council; prepare the Council Agenda and the Council Chambers; prepare the Agenda Study; answer citizen inquiries; maintain the Orange Municipal Code books; administer the Clerk's office; file contracts,agreements and deeds; process annexations, resolutions,ordinances and claims; arrange the invocation for Council meetings; maintain City contracts, agreements and deeds, and index all Council actions and perform such further and related duties as the City Manager or City Council may request.Published, Orange City News, August 22, 1979, 2) Remsvalof Chief Clerk: a) Vote required. The removal of Chief Clerk shall be only upon a three-member vote of the whole Council of the City at a regular Council meeting;subject, however, to the provisions of the next succeeding subsections. In case of the intended removal by the City Council, the Chief Clerk shall be furnished with the written notice stating the City Council's intention to remove said Clerk. The effective date of such removal shall be shown upon the written notice.b) Hearing. Within seven (7) days after the delivery to the Chief Clerk of such notice, said Clerk may,by written notification to the City Manager, request a hearing by the City Council. Thereafter, the City Council shall choose a time for the hearing which shall be held at its usual meeting place and at which the Chief Clerk shall appear and be heard. In removing the Chief Clerk, the City Council shall use its uncontrolled discretion, and its action shall be final and shall not depend upon any particular showing or degree of proof at the hearing; the purpose of which is to allow the Chief Clerk to present to said City Council the grounds of opposition to such removal.3) Compensation:The Chief Clerk shall receive such compensation and expense allowance as the City Council shall from time to time determine, and said compensation and expenses shall be a proper charge against such funds of the City as the City Council shall designate.SECTION II:This ordinance shall be published once within fifteen ( 15)days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.ADOPTED this 14th day of August 1979.
