ORDINANCE NO. 39-79 'IARILYN J, JENSEN, CITY CLERK AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTING THE UNIFORM BUILDING CODE,1976 EDITION, AND APPENDIX, AND THE UNIFORM BUILDING CODE STANDARDS, 1976 EDITION, BOTH BY REFERENCE, PROVIDING FOR FIRE, LIFE AND STRUCTURAL SAFETY ASPECTS OF ALL BUILDINGS AND RELATED STRUCTURES, AND WITH CERTAIN AMENDMENTS, AND FIXING PENALTIES FOR VIOLATION.THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Sections 8100 through 8103 of the Orange Municipal Code are amended to read as follows:section 8100 Adoption of the Uniform Building Code.1976 Edition, and Uniform Building Code Standards, 1976 Edition.The Uniform Building Code, 1976 Edition, and Uniform Building Code Standards, 1976 Edition, published by the International Conference of Building Officials, with the changes, additions and deletions set forth in Section 8101 of the Orange Municipal Code are adopted by reference. The required copies are on file in the office of the City Clerk for use and examination by the pub1 ic.Section 8101 Modification of the Uniform Building Code,1976 Edition.The Uniform Building Code, 1976 Edition, as adopted in Section 8100 is adopted with the following changes and additions:a) Amendment of section 103:Section 103 is amended by adding the following paragraph:The Building Official may exempt incidental structures and improvements of a minor nature from the application of this Code.b) Amendment of Section 303( a):The following paragraph is hereby added:In addition, a fee of $3.00 shall be paid as a permit issuance fee for each building permit issued.c) Amendment of Section 303 to add ( e):The following Subsection (e) is hereby added:Investigation Fee. A fee of Twenty- five dollars 25.00) may be charged by the Building Official for any investigation of a building, structure,work reports, certification, or any other related work requested by an owner or d) Amendment of Section 1807: All of Section 1807 is repealed except the first paragraph of Subsection (a), and Paragraphs (i), Hi), and (iv) of Subsection (m)(2). e) Amendment of Section 1907: Section 1907 is amended by adding the words "as amended" at the end of the words "Section 1807" in the first sentence. f) Amendment of Section 7005 (Definitions): The following Subsection "Building Official" is hereby added: Building Official: For the purpose of this chapter only, the Building Official shall mean the City Engineer or his designated representative. Fire Sprinkler Ordinance to Prevail over Uniform Building Code, 1976 Edition. Section 8102 is hereby added: Section 8102 Whenever Article III, Chapter 8 - Fire Prevention Code,Section 3800 et seq., imposes stricter standards then imposed by this Code, Article III, Chapter 8 - Fire Prevention Code, Section 3800 et seq., is to govern.Section 8103 Violations and Penalties.Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed,continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $ 500.00, or by imprisonment for not more than six months, or by both such fine and imprisonment.In addition, this Code may be enforced by injunction or appropriate civil remedy.SECTION II: This ordinance shall be published once within fifteen (15)days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.ADOPTED this 11th 1979.day ofSeptemberATTEST:Mayor of the D>- rJ v- -.;?D "City of Orange t~' flr City Clerk of tCRyofOrnge2- STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss CITY OF ORANGE ) I, ~RILYN J.
