JENSEN, CITY CLERK ORDINANCE NO. 38- 79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTING, BY REFERENCE, THE NATIONAL ELECTRICAL CODE, 1978 EDITION, AND APPENDIX,PROVIDING FOR A PRACTICAL METHOD FOR THE SAFEGUARDING OF PERSONS AND OF BUILDINGS AND THEIR CONTENTS FROM HAZARDS ARISING FROM THE USE OF ELECTRICITY FOR LIGHT, HEAT, POWER,RADIO, SIGNALING AND OTHER PURPOSES, AND WITH CERTAIN AMENDMENTS, AND FIXING PENALTIES FOR VIOLATION.THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Chapter 3, Part I, containing Sections 8300 through 8302 of the Orange Municipal Code are amended to read as follows:Adoption of the National Electrical Code,1978 Edition, and Appendix.The National Electrical Code, 1978 Edition, and Appendix,published by the National Fire Protection with the additions,changes, and deletions set forth in Section 8301 of the Orange Municipal Code are adopted by reference. The required copies are on file in the office of the City Clerk for use and examination by the public.Section 8300 Section 8301 Modification of the National Electrical Code,1978 Edition.The National Electrical Code, 1978 Edition, is adopted with the following additions, changes and deletions:ARTICLE 110 - - REQUIREMENTS FOR ELECTRICAL INS TALLATIONS Section 110-5 is amended by adding the following paragraph to read as follows: Section 110-5 Conductors. No aluminum conductor smaller than No.6 AWG shall be used.ARTICLE 210 - - BRANCH CIRCUITS Section 210-1 is amended to read as follows: Section 210-1 Scope. The provisions of this Article apply to branch circuits supplying lighting or appliance loads or combinations of such loads. Where motors, or motor-operated appliances, are connected to any circuit supplying lighting or other appliance loads, the provisions of both this Article and Article 430 shall apply. Article 430 shall apply where branch circuit supplies only a. Accessory uses or other buildings, signs, etc., separately located on the same lot or premises shall have connecting conductors run underground. (Agricultural areas excepted.) b. Where space circuit protective devices are provided or space for future circuit protective devices is provided on the buss in any flush or semi-flush mounted panel,then raceways of sufficient capacity to permit utilization of such spaces or spaces shall be provided to an approved accessible location. Such accessible location is normally defined as follows:Where sufficient attic space is available or underf100r space is available, a raceway shall terminate conveniently for future use in each such space. Where this condition does not exist, then such terminations shall be approved by the enforcing authority.The last sentence of Section 2l0-25(b) on Page 70-36 is amended to read as follows:For a one-family dwelling, at least one receptacle outlet, in addition to any provided for laundry equipment,shall be installed in each basement, garage, and carport.Garages or carports adjacent to dwelling units shall be wired with a minimum of one switched light outlet and one receptacle per each two auto stalls or fraction thereof. This wiring, if exposed, shall be in approved metal raceways. All wiring to detached accessory buildings shall be run underground.No convenience receptacle or appliance receptacle shall be installed or operated on a general lighting branch circuit at any time in any occupancy.The first two paragraphs of section 210-26(a) are deleted and the following four paragraphs added: Section 210-26 Liqhting Outlets Required.a.1. Dwelling-Type Occupancies: At least one wal1- switch controlled lighting outlet shall be installed in every habitable room; in hallways, stairways,garages, carports, and at outdoor entrances.2. All Occupancies: At least one lighting outlet shall be installed in attic, underf100r space,utility area and basement where used for storage or containing equipment requiring servicing, and at ingress or egress of commercial type buildings. 3. Area Lighting: Every multiple dwelling complex shall be illuminated with not less than one foot-candle at floor or ground level along walkways to a public way. This lighting shall be provided continuously from sun-down to sun- up.4. Area Lighting - Commercial and Industrial Complexes and Parking Areas: Sufficient lighting shall be provided ARTICLE 230 - - SERVICES Section 230- 43 is amended to read as follows:Section 230-43 Wiring Methods for 600 Volts or Less. Service entrance conductors extending along the exterior or entering buildings or other structures shall be enclosed in rigid metal conduit to the first over-current device, or for circuits not exceeding 600 volts in wire ways auxiliary gutters or as busways. (Overhead services.)Section 230-7l(a) is amended to read as follows:section 230-7l(a) Disconnection from Service Conductors.A single fusible switch or automatic circuit breaker shall be provided to disconnect all ungrounded conductors supplying each separately-metered occupancy.ARTICLE 300 - - WIRING METHODS Section 300-15(b) is amended by deleting Exceptions No.1 and No.5.ARTICLE 336 - - NON-METALLIC SHEATHED CABLE The first paragraph of Section 336-3 is amended to read as follows:Section 336-3 Uses Permitted or not Permitted. Non-metallic sheathed cable shall not be used for exposed wiring and shall only be used for concealed wiring in one and two family dwellings or multi-family dwellings (apartment houses) not exceeding three floors above grade.Article 336 is amended by deleting Section 336-6 in its entirety. ARTICLE 350 - - FLEXIBLE METAL CONDUIT Section 350-2 is amended by adding Subsection ( 7)to read as fo 110ws : 7. Where exposed to physical damage.ARTICLE 422 - - APPLIANCES Section 422-5 is amended by adding paragraph ( c) to read as follows: Section 422-5 Branch Circuit Sizing.c) Fixed Appliances: Each dwelling unit shall have installed therein an individual food waste grinder branch circuit.said circuit shall be supplied with a 15 ampere indicating-type switch. Said switch shall be located in the wall adjacent to the sink. A food waste grinder shall be wired with a minimum of No. 16 AWG, 3-wire SPT-3 thermoplastic hard finish cord or its equal and an approved grounding Section 8302 Violations and Penalties. Any person, firm or corporation violating any of the provl.sl.ons of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500.00, or by imprisonment for not more than six months, or by both such fine and imprisonment. In addition, this Code may be enforced by injunction or appropriate civil remedy. SECTION II: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
