79 AN INTERIM ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE ADOPTED AS AN
URGENCY MEASURE AMENDING SECTION 9100.21 OF
THE ORANGE MUNICIPAL CODE RELATING TO
THE DEFINITION OF "HOME
OCCUPATION".WHEREAS, the City Council of the City of Orange,
on February 11, 1969, adopted Ordinance No. 15-69
which amended the definition of "home
occupation"; and WHEREAS, Ordinance No. 15-69 was enacted,
based upon the findings set forth in Resolution No. 3096 of the
City Council of the City
of Orange; and WHEREAS, it was the intent of the City
Council to allow home occupations" which were secondary in nature
to the primary use of
a residence; and WHEREAS, it was the intent of the City
Council that such home occupations" should not interfere with
the quiet enjoyment of residences in the area of
home occupations; and WHEREAS, it was the intent of the City
Council that such home occupations should not endanger residences
nor citizens in the area of
home occupations; and WHEREAS, the City Council finds that the
sale of firearms and ammunition from a residence as a home
occupation is fraught
with peril; and WHEREAS, the City Council finds that
the potential dangers relating to fires or explosions in connection with
the sale of firearms and ammunition outweigh the possible
benefits of allowing the sale of firearms and ammunition as a
home occupation; and WHEREAS, the City Council finds that there
is the potential for serious problems regarding the accessibility
of firearms and ammunition to children
and young people.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF ORANGE DOES
ORDAIN AS
FOLLOWS:SECTION I:Section 9100.21 of the Orange Municipal
Code is hereby amended to
read as follows:Section 9100.
21 Home Occupation"A home occupation is one carried on in
the dwelling by the occupant of that dwelling as a
secondary use, where there are no displays or signs at or upon
the premises, no commodity or services are sold upon the
premises, no other non-occupants employed at that
location, no storage or materials and/or supplies upon
those premises except within the dwelling or an enclosed garage.
Any materials and/or supplies which are stored upon the
premises shall be limited and shall not occupy a space in excess of
2,000 cubic feet.Such an occupation shall not
create light, noise, odor,dust, vibration, fumes or smoke
readily discernible at the exterior boundaries of the parcel; nor
involve the use of mechanical equipment not recognized as
a part of reasonable household use; nor involve the sale
SECTION II:
The reasons for the urgency of this ordinance are as
follows:
The City Council of the City of Orange finds and determines
that the operation of home occupation in a residential area
involving the sale of firearms and ammunition endangers the lives
and property of those who would conduct such a home occupation
and the residents of a domicile where such activity was to take
place. Further, such activity would endanger the lives and
property of residents in the area of such activity. There are
certain individuals who are seeking to operate a firearms and
ammunition sales business as a home occupation. If they were to
operate such a business, it may cause serious damage to the
welfare of the citizens of the City of Orange.
THEREFORE, pursuant to the procedures of Section 36937 of
the Government Code, the City Council of the City of Orange
hereby enacts this ordinance as an urgency measure in order to
protect the public health, safety and welfare until the time the
permanent ordinance becomes effective.
