OF THE CITY COUNCIL OF THE CITY OF ORANGE
REPEALING SECTIONS 4232.1, 4232. 2 AND 4232.
3, AMENDING SECTIONS 4230.2, 4232,6520, 6520.
7 AND 6520.8, AND ADDING SECTION 6520.9
OF THE ORANGE MUNICIPAL CODE REGULATING BEVERAGE CONTAINERS
AT SPECIAL PAGEANTS.WHEREAS, the
City Council enacted Ordinance No 45-77 concerning
the use and control of alcoholic beverag~s on City property
during special pageants, and WHEREAS,
said ordinance prohibited the sale, consumption or possession
of alcoholic beverages in containers capable of being thrown
to cause injury to persons or damage to property, and WHEREAS,
the City Council has determined that the health and safety
of the citizens of Orange would be best served by prohibiting the
sale, consumption or possession of any kind of beverage,whether
alcoholic or nonalcoholic, at special pageants conducted on
City property.NOW,
THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN
AS FOLLOWS:SECTION
I:Sections
4232.1, 4232.2 and 4232.3 of the Orange Municipal Code
are hereby repealed.SECTION
II:Sections
4230.2 and 4232 shall be amended to read as follows:Section
4230.2 Same, Drinking Alcoholic Beverages in Public.No
person shall drink any alcoholic beverage on any street,
park, public parking lot, r~ilway depo~ or othe:public
place, or in any automobile ~n any publ~c place ~n the
City except as provided in Section 6520,7 of the Orange Municipal
Code. The term . alcohol ic beverage" shal ~ be as defined
by the Alcoholic Beverage control Act of th~s State.Section
4232 Intoxicating Liquor, Selling, Etc., in Certain Public
Places Prohibited.No
person shall possess, consume, deliver, furnish,sell,
or give to any other person, or buy or r7ceive from,any
other person any alcoholic beverage at or ~n a~y ~ubl~c grounds,
premises, parks or recreation areas o~ bu~ld~ng~ 'thereon
and including any school grounds, prem~ses or bu~ld~ngs and
such portions of the Orange County Complex grounds,premises
or buildings as may be within the c~t~ except as provided
in Section 6520.7 of the Orange MUnl?~pal Code.The
term "alcoholic beverage" shall ~e as def~ned by the Alcoholic
Beverage control Act of th~s State,

CTION III:Section
6520 Definition shall be amended by revising the fourth
sentence of the second paragraph of said section to read as
follows:Nothing
contained herein shall be construed to include wi
thin the def ini tion of a "special pageant" any "pancake breakfast," "
bake sale," or similar event sponsored by a nonprofit
or~anization wher7 only food or beverages are served,
prov~ded that the Clty Manager shall have discretion to
require the posting of a cash deposit to insure cleaning of
the area in which food or beverages only are served.SECTION
IV:Section
6520.7 shall be amended by adding one (1) additional paragraph
after the three existing paragraphs to read as follows:The
City Council may authorize the sale and permit the purchase,
possession and consumption of alcoholic beverages at
a special pageant in a manner hereinafter provided in Sections
6520.8(a) and 6520.8(b) of this Code. The term alcohol
ic beverages" used in this Section and in Sections 6520.
8(a) and 6520.8(b) shall be as defined by the Alcoholic Beverage
Control Act of this State.SECTION
V:Section
6520.8 Penalty shall be renumbered to read Section 6520,
9.b)
No
vendor shall sell, deliver, give, or otherwise furnish
to any person at a special ~ageant any alcoh~lic or
nonalcoholic beverage in a conta~ner made all or ln part
of metal, glass or similar sub~t~nces capable of being
thrown or propelled with sufflc~ent force as to cause
injury if striking the person or property of another.
No
person shall consume, deliver, buy, receive or ,otherwise
possess at a special p~geant any alcoho~lC nonalcoholic
beverage in a contalner made all or ~n part
of metal glass or similar substances capable of being
thrown ~r propelled with sufficient force as to cause
injury if striking the person or property of another.
