CHARLOTTE M. .TOHNSTON, me,--..f.!.!! eLl'll!:.ORDINANCE NO. 26-79 AN ORDINANCE OF THE CITY COUNCIL OF TilE CITY OF ORANGE AMENDING SECTION 3l52.3(c) OF THE ORANGE MUNICIPAL CODE TO REQUIRE PUBLIC LIABILITY, PROPERTY DAMAGE AND WORKER'S COMPENSATION INSURANCE IN CONTRACTS BETWEEN THE CITY AND ANY PERSON FOR THE COLLECTION OF TRASH AND GARBAGE. WHEREAS, Section 3152.3 of the Orange Municipal Code requires that all trash, garbage and construction debris accumulated in the City shall be collected, conveyed and disposed of by the City or its authorized representative, and WHEREAS, Section 3152.3 of the Orange Municipal Code provides that the City shall have the right to enter into a contract with any person for the collection of trash and garbage, and WHEREAS, the City Council of the City of Orange sets forth its intent that such a contract would include public liability, property damage and worker's compensation insurance by adopting Resolution No. 4442 on November 23, 1976, and WHEREAS, the City Council of the City of Orange desires that the contractor be required by ordinance to have such insurance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Section 3152.3(c) of the orange Municipal Code is amended to read as fo llows : c)The City shall have the right to enter into a contract with any person for the collection of trash and garbage. The contractor shall maintain in full force and effect during the term of the contract a public liabil ity policy with a $ 500,000 limit, and ~ J?roperty damage insurance policy with a $100,000 l~m~t. Th7 contractor shall maintain in full force and effect dur~ng the term of the contract an adequate Worker's Compensat~on policy and such other insurance ~s may be req~~:ed by law. Said policies shall name c~ty as an add~t~onal insured and shall contain an endorsement providing that such policies will not be cancelled~ modified, or reduced in limit until notice in w:~ting shall have, been given to the City at least th~rty (30) days pr~or to the time of such cancellation, modification or reduction in limit becomes effec~ive. ,contractor's insurance shall be considered pr~mary ~~surance, not , contributing with and not in excess of ~nsurance carr~ed by City. g;CTION II: This o:dinance sha~l be published once within fifteen (15) days afte: ~ts p~ssage ~n,the Orange City News, a newspaper of general cHculat~on, pubhshed and circulated in the City of Orange, and ~hall, take effect thirty (30) days from and after the date of ~ts f~nal passage.
