AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ORANGE ADDING SECTIONS 6327 ET SEQ. TO THE
ORANGE MUNICIPAL CODE RELATING TO TAXING AND
REGULATING ANTIQUE SIIOPS.
WHEREAS, the City Staff and members of the Antique Association
have met to discuss taxing and regulating antique shops, and
WHEREAS, the City Council of the City of Orange is of the
opinion that bona fide antique shops are a specialized enterprise
and should be separated from other secondhand enterprises, and
WHEREAS, the City Council of the City of Orange is of the
opinion that the nature of antiques is derived from its age or
its historical associations as differentiated from common secondhand
merchandise, and '
WIIEREAS, the City Council and the Police Department of the
City of Orange has determined that in regulating antique shops
only, the following regulations are germane to that type of
business.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
O~AIN AS FOLLOWS:
SECTION I:
Sections 6327, 6327.1 and 6327.2 are hereby added to the
Orange Municipal Code and shall read as follows:
Chapter 3-
B ANTIQUE
SHOPS Section 6327
Definition As used in this chapter, "ANTIQUE SHOP", means a
shop where secondhand merchandise is sold at reta~l, but where
at least ninety percent (90%), measured according to v~lue,
of the used or secondhand merchandise on hand at any t~
me consist of objects of art, bric-a-brac,
curios, or hous7hold furniture or furnishings, offered for sale upon
the bas~s,express or implied, that the value of , the property,
w~ole or in substantial part, is derived from ~ts age
or from ~
ts historical associations,Section 6327.
1 Permit Requirements The operator of any antique shop may, in
lieu ?f the secondhand dealer's permit required by Oran~e
Munic~pal Code Section 6450 1 apply for and obtain a
speclal permlt to conduct an a~tique shop. such application shall
be made to the Business Services Coordinator who sh~ll re~
er ~ll such applications to the Chief of police for lnvestlg~

section 6327.2 Buying, Reporting, and HOlding Requirem~
The holder of an antique shop permit is exempt from
requirements set forth in Section 6450 et seq. of the Orange
Municipal Code, except however, that when permittee is
buying, in receipt of, handling, disposing or selling serialized
secondhand property, precious metals or jewelry that the
following provisions shall apply:
a) Permittee shall report all serialized secondhand property,
precious metals or jewelry which he has purchased,
taken in trade, taken in pawn, accepted for sale on
consignment, or accepted for auctioning to the Chief of
Police of the City of Orange, not later than twelve
noon of the day following the acquisition of such
property.
b) Such reporting, holding, and buying of serialized
secondhand property, precious metals or jewelry by
permittee shall be according to and be in compliance
with Orange Municipal Code Section 6450.4 through and
including 6450.10.
SECTION II:
This ordinance shall be published once wi thin fifteen (IS)
days after its passage in the Orange City News, a newspaper of
general circulation, published and circulated in the City of
Orange, and shall take effect thirty (3 0) days from and after
the date of its final passage.
