Box 449, Orange, CA 92666' , and send PROOF and Proof of CHARLOTTE M, JOHNSTON, CMC, CITY CLERK ORDINANCE NO. 23-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING SECTIONS 4270 THROUGH 4270 17 OF THE ORANGE MUNICIPAL CODE, AND ADDING SECTIONS 6374 THROUGH 6374.6 THERETO, GOVERNING THE ISSUANCE OF ENTERTAINMENT JilERMITS IN THE CITY OF ORANGE. have and WIIEREAS, the City Council of the City of Orange desires to uniformity in the procedures for the issuance of permits, WIIERE~S~ the Business Permits and Regulations article of the Orange Mun~c~l?a~ Code se~s forth the general procedures for the lssuance of s~m~lar perm~ ts. NOW, THEREFORE, TilE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Sections 4270 through 4270.17 of the Orange Municipal Code are hereby repealed. Sections 6374 through 6374.6 are added to the Orange Munic ipal Code to read as follows: Section 6374 Defini tions The following term used in this chapter shall have the meanings indicated below: ENTERTAINMENT shall mean every form of live entertainment, music, solo band or orchestra, act, play, burlesque show, fashion show, review, pantomine, scene, song or dance, act or song, and dance act, or any other act or performance participated in by one or more persons for the purpose of holding the attention of, gaining the attention and interest of, diverting or amusing guests or patrons, and shall include many of such forms of live entertainment when used in connection with, or as a means to attract or hold the attention of such guests or patrons for the purpose of advertisement, demonstration or display of goods, wares, merchandise, or services Prior Code Section 4270) Section 6374.1 Permit Required No person shall perform, provide or permit any entertainment, open to the public, within the City, without obtaining a proper permit therefor, as herein provided, (Prior Code Section 4270.1) Section 6374.2 Exclusions The provisions of Section 6374.1 shall not be deemed to require a permit for the following: a) The use of a radio or music recording machine, or juke box in any establishment; b)Any entertainment provided for members and their at a private club where admission is not open to public; guests the c) Entert<;,inment conduc;:ted in connection with a regularly establ~shed recreat~on park, circus, or fairground; d) E~tertainment c;:onducted by or sponsored by any bona f~de c;:lub, soc;:~ety, association, church or school, organ~~ed or 7ncorporated for benevolent, charitable, dramat~c,or l~ter~ry purposes having an established members~~p and wh~ch holds meetings other than such enterta7n~ent at regular intervals, when proceeds, if any, ar~s~ng from such entertainment are used for the purposes of such club, society, association church or school. (Prior Code Section 4270.2) , Section 6374.3 Appl ication Application for an entertainment permit shall be made to the Chief of Police upon forms to be furnished by the Business Services Coordinator. In addition to any other information which may reasonably be required by the Chief of police, said application shall contain the information in Section 6310. (Prior Code Section 4270.3) Section 6374.4 Police Investigation The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. Applicant shall pay the amount set by the State for processing the fingerprints. The Chief of Pol ice shall cause an investigation of each applicant to be made to determine if such applicant has committed any act that if done by a permittee would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of a felony or any crime that has a substantial rela'tionship to the permitted entertainment, Prior Code Section 4270.5) section 6374.5 Issuance The Chief of police shall approve or deny the permit within a reasonable time. Upon approval by the Chief of Police, the Business services Coordinator shall issue an entertainment permit. (Prior Code Section 4270.5) section 6374.6 Fee A fee of Ten Dollars ($10,00) for the applicant, together with Five Dollars ($5.00) for each entertainer to be engaged under applicant's permit shall be pai~ to City upon the filing of each application for a perm~t for the ~urpose o~ defraying the expenses incidental to the process~ng of sa~d application. Prior to engagement, the applicant shall pay to City a fee of Five Dollars ($5.00) for each subsequent entertainer to be included in his permit as an amendment thereto.
