AN ORDINANCE OF THE CITY COUNCIL OF TilE CITY
OF ORANGE AMENDING SECTION 9l14.l2(a) OF THE
ORANGE MUNICIPAL CODE RELATING TO EFFECTIVE
TIME OF VARIANCES AND CONDITIONAL USE PERMITS.

ORANGE WHEREA~, after ~he duly held public hearing on March
27,1979, the Cl. ty Councl.l found and determined that the one

applicants wlth suffl.cl.ent tl.me to utl.ll.Ze the variances or conditional
use permits granted,
and WHEREAS, eighteen months would be a more reasonable
period of time than one year for applicants to utilize their
variances and conditional use permits and considerably reduce
City administrative time now used to process requests for
extensions.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS
FOLLOWS:SECTION
I:Section 9ll4.12(a) of the Orange Municipal Code is
hereby amended to read as
follows:section 9114.12 Revocation of Variances and
Conditional Use
Permits a) A variance or conditional use permit granted
in accordance with the terms of this Article shall
be revoked if: (1) it has not been used in
accordance with the terms of approval; (2) was obtained
under fraud or misinformation; or (3) has ceased to
exist for more than eighteen
months.Every variance or conditional use permit issued af~
er the effective date of this Section shall become vOl.
d,unless the use or construction has begun within
eighteen months after the date said variance or conditional
use permit was approved. The Planning Commission may
upon written request prior to expiration extend the
length of time of an approve~ variance or c?ndit~onal
use permit upon presentatl.bn of extenuat~ng cl.
rcumstances.SECTION
II:This ordinance shall be published once within fifteen (
15)days after its passage in the Orange City News, a newsl?aper
of general circulation published and circulated in the Cl.ty
of Orange, and shall t~ke effect thirty (30) days from and
after the date of its final
passage.ADOPTED this 17th day of April
