79 AN ORDINANCE OF THE CITY COUNCIL OF TilE
CITY OF ORANGE AMENDING SECTIONS 6450,5 AND 6450,
9 OF THE ORANGE MUNICIPAL CODE RELATING
TO PAWNBROKERS, SECONDHAND DEALERS AND
AUCTIONEERS.WIIEREAS, numerous meetings and discussions were had
between concerned merchants and the City Staff,
and WHEREAS, as to goods, wares or merchandise which are
accepted lfi trade and as part payment for new merchandise it has
been determined that such transactions are not conduits for
stolen merchandise and, therefore, need not be regul ated,
and WHEREAS, the City Council desires the Chief of Police or
his designee( s) in the Detective Division to have the discretion
to waive any part of the holding requirement on property,
when determined to be in the public interest to do
so.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS
FOLLOWS:SECTION
I:Section 6450.5(i) shall be added to the Orange
Municipal Code to read as
follows:i) The provisions of this chapter have no application to
a person whose sales of secondhand personal property
are confined to the disposal of goods accepted in trade
and as part payment for new merchandise, provided
further,however, that such new merchandise is not then
redeemable in cash to the person trading or exchanging the
used
item.SECTION
II:The following shall be added to Section 6450.9 of the
Orange Municipal
Code:The Chief of police or his designee(s) in the
Detective Division may release any property ~overed by this,sect~
on and waive any holding period there~n, when determ:ned ~n
the public interest to do so, Any such release or wa1ver
shall be in writing and signed by th7 ~h~ef of Police or ~
is designee(s) in the Detective D~V~slOn on an appropr~ate
form designated by the police Department for such
purpose,SECTION
III:This ordinance shall be published once within fifteen (
15)days after its passage in the Orange ,City News~ a newspaper
of general circulation, published and c~rculated ~n the city
of Orange, and shall take effect thirty (30) days from and
after the date of its final
passage.ADOPTED this 20th day of
