HomeMy WebLinkAboutORD-04-79 RECLASSIFICATION OF PROPERTY SITUATED AT THE SOUTHWEST CORNER OF LINCOLN AVENUE AND BATAVIAORDINANCE NO. 4-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 9101 OF THE ORANGE MUNICIPAL CODE AND APPROVING THE RECLASSIFICATION OF PROPERTY SITUATED AT THE SOUTHWEST CORNER OF LINCOLN AVENUE AND BATAVIA STREET. Pre-Zone Change 884 CADILLAC-FAIRVIEW HOMES WEST RECITALS:WHEREAS, after report thereon by the Planning and after due public hearings as required by law finding the facts as shown by Resolution No. 4925 the City Council, the City Council of the City of concluded that the following amendment to Section Orange Municipal Code should be adopted, and Commission and after adopted by Orange has 9101 of the WHEREAS, there now exists in the unincorporated territory of the County of Orange certain real property hereinafter described which is designated as County of Orange M- l District, and WHEREAS, the City of Orange desires that the property hereinafter described be classified as City of Orange RD-8 District upon completion of annexation proceedings incorporating the territory into the City of Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:The following described real property is hereby changed to City of Orange RD-8 District, said zoning to be effective upon annexation of said real property to the City of Orange. Said real property is more particularly described as follows:All that certain real property situated in the Rancho Santiago de Santa Ana in the unincorporated territory of the County of Orange, State of California, described as follows:BEGINNING at the centerline intersection of New Lincoln Avenue and Batavia street as shown on a map filed in Book 99, Page 21, Records of Survey of said county;thence along the centerline of said Batavia Street South 00 59' 36" West 30.26 feet to the intersection of said Batavia Street and the old centerline of said Lincoln Avenue as shown on said Record of survey being also the TRUE POINT OF BEGINNING; thence continuing along the centerline of Batavia ~tree;t so~th 00 59' .36"West 2292.68 feet to an angle po~nt 1n sa~d centerl~ne;said angle point being also,the point of intersection of said centerline of Batav~ a Street and the Northwest boundary of the land of Minnie Rieger as established by compromise boundary agreement recorded in Book 499,Page 160 of Deeds, leaving said centerline and along said compromise boundary South 500 53' 25" West 500.09 feet to a point in the North line of that certain property conveyed to Kimbrell Construction Company by deed recorded in Book 9392, Page 166, Offical Records; thence along said North line and the Westerly prolongation thereof North 890 21' 07" West 520.66 feet to a point on a line that is parallel with the Easterly line of that certain strip of land 70.00 feet wide as described in a deed to the Orange County Flood Control District recorded in Book 977, Page 576, Official Records, and distant Easterly therefrom 100.00 feet measured at right angles;thence along said parallel line North 150 48' 40" East 1698.82 feet to the beginning of a curve concave to the East having a radius of 3,700.00 feet; thence along said curve through a central angle of 110 03' 10" an arc distance of 713.76 feet; thence tangent to said curve North 260 51' 50" East 83.01 feet to the intersection of said parallel line and a compromise line as set forth in an instrument recorded in Book 280, Page 67 of Deeds, records of said county; thence leaving said parallel line and along said compromise line North 00 10' 50" East 287.08 feet to a point on said old centerline of Lincoln Avenue and distant North 720 51' 35" West 196.44 feet from the True Point of Beginning; thence along said old centerline South 720 57' 35" East 196.44 feet to the TRUE POINT OF BEGINNING.SECTION II: This ordinance shall be published once within fifteen (15)days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.ADOPTED this 23rd day of January 1919.V'/'::{..Gll , C) ~~. -:r-----Mayor of the City of o~ge ATTEST:Ci~;~i{ e~~ ~~~ 7~;~~~ f CMC Orange STATE OF CALIFORNrA )COUNTY OF ORANGE ) ss CITY OF ORANGE )r, CHARLOTTE M.
