CITY CLERK ORDINANCE NO. 1-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADDING SECTIONS 4253 AND 4253.1 TO THE ORANGE MUNICIPAL CODE REGULATING NUDITY ON PUBLIC LAND AND PRIVATE PROPERTY OPEN TO PUBLIC VIEW.WHEREAS, the City Council finds that it is in the public interest and necessary to protect and promote public health,safety and welfare, that parks, playgrounds and streets be utilized and enjoyed by as many persons as possible, and WHEREAS, the City Council finds that maximum utilization and enjoyment of said parks, playgrounds and streets can only be obtained through imposition of regulations regarding activities thereon, and WHEREAS, the appearance of some persons utilizing said parks, playgrounds and streets by appearing thereon without clothing and with the private parts of their bodies exposed,unreasonably interferes with the right of all persons to use and enjoy said parks, playgrounds and streets by causing many persons to leave and others not to come to said parks, playgrounds and streets, and WHEREAS, the City Council finds that such conduct and behavior imposes an extraordinary and unusual burden on City employees charged with the maintenance of said parks, playgrounds and streets and public safety personnel who are diverted from fulfilling their primary obligation to protect the health, safety and welfare of the public at large, and WHEREAS, the City Council finds that the presence of persons who are unclothed and exposed to public view in or on public rights of way, parks, playgrounds, and streets, or on any private property open to public view from public parks, playgrounds,streets or other public ways tends to discourage the use and enjoyment of said public parkS, playgrounds, streets and public ways of the City, and creates a nuisance and is offensive to members of the public who wish to use and enjoy said public parks, playgrounds, streets and public places, and who are unwillingly exposed to such conduct, and WHEREAS the City council finds that addition of Sections 4253 and 4253.1 will protect the public health, safety and welfare.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Sections 4253 and 4253.1 are hereby added to the Orange Municipal Code to read as follows:Section 4253 Prohibitions No person shall appear, bathe, sunbathe, walk,or be in any public park, playground, street, or,oth7r publlC land,or in any private property open to publl? Vlew from any,public right-of-way public street, publlC park or publlC land in such a man~er that the genitals, pubic hair,butt~cks anus anal region or pubic hair region of any person i~ expo~ed to public view or is not covered by an opaque l,._~ section 4253.1 Exemptions section 4253 shall not apply to: a. Children under the age of ten years. b. Live theatrical performances performed in a theater, concert hall, or other similar establishment located on public land. SECTION II: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 16th day of January 1979.
