ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ORANGE ADDING SECTION 17.44.021 TO THE ORANGE
MUNICIPAL CODE TO INCLUDE REQUIREMENT FOR
A CONDITIONAL USE PERMIT FOR SALE OR DELIVERY
OF ANY ALCOHOLIC BEVERAGE AS ACCESSORY
USE TO THE OPERATION OF AUTOMOBILE SERVICE
STATION AND AMENDING SECTION 17.94.060 TO
AUTHORIZE ZONING ADMINISTRATOR TO GRANT SAME.WHEREAS,
there were duly held public hearings before the Planning
commission and the City Council concerning the sale or delivery
of alcoholic beverages at automobile service stations;and
WHEREAS,
because of problems of law enforcement, the City Council
has determined that each application for the sale of alcoholic
beverages as an accessory use to the operation of a service
station shall be subject to a conditional use permit.NOW,
THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN
AS FOLLOWS:SECTION
I:Section
17.44.021 is hereby added to the Orange Municipal Code
and shall read as follows;Section
17.44.021 Use subject to conditional use permit issued
by Zoning Administrator. Sale or delivery of any alcoholic
beverage as an accessory use to the operation of an
automobile service station. A conditional use permit shall
be granted by Zoning Administrator as provided in Section
17.94.060 E. No conditional use permit shall be granted
unless:A.
The applicant has submitted a written statement describing the
methods proposed for the delivery of fuel and alcoholic
beverages to customers and the method for the payment
of same; and B.
After a pub 1 ic hearing, the following findings have been
made;1.
That there is reasonable assurance that any customer
for fuel or alcoholic beverages must exit from
his motor vehicle to obtain and pay for same;and
2.
That the proposed sale or delivery of any alcoholic beverage
is reasonably consistent with surrounding land
uses.SECTION
II;The
following is hereby added to Section 17,94.060 and shall road
as follows:Section
17.94.060 E.
Permits for the sale or delivery of any alcoholic beverage
as an accessory use to t~e operation ,?f a~automobile
service station aecord~ng to the cr~ter~a set
forth in Section 17.44.021.
SECTION II I:
This ordinance shall be published once within fifteen (15)
days after its passage in the Orange City News, a newspaper of
general circulation, published and circulated in the City of
Orange, and shall take effect thirty (30) days from and after
the date of its final passage.
