JENSEN , CITY CLERK ORDINANCE NO. 51- 80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE CONCERNING PERSONNEL MATTERS AND DEPARTMENTAL ORGANIZATION,AMENDING SECTION 2.16.020C, REPEALING SECTION 2.16.050, AMENDING SECTION 2.20.010 AND SECTION 2.20.0400, ADDING SECTION 2.20.040G AND 2.20. 060Al3,REPEALING SECTIONS 2.21.010 THROUGH 2.52.040, AND ADDING SECTIONS 2.22. 010 THROUGH 2.48.010 OF THE ORANGE MUNICIPAL CODE.WHEREAS, the City Council of the City of Orange is desirous to inaure that Orange Municipal Code properly sets forth the departmental organization of the City of Orange; and WHEREAS, certain modifications have occurred in the departmental organization of the City of Orange which warrant amendment of the Orange Municipal Code; and WHEREAS, these amendments are aport:i,on of the continuing updating of the Orange Municipal Code.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 2.16. 020 C of the Orange Municipal Code is amended to read as follows:C. Annual Report. Shall prepare and present to the Council an annual report of the City's affairs, including a sllllUl\aryof reports of department heads, and such other reports as the Council shall require. Said report may be integrated into the annual budget report.SECTION II:Section 2.16.050 of the Orange Municipal Code is hereby repealed.SECTION I II :Section 2.20.010 of the Orange Municipal Code is amended to read as follows:Section 2.20.010 Departmental organization The Administrative Service of the City shall be divided under the Administrator into the following departments and heads thereof:Department of Law - City Attorney Department of Treasury - City Treasurer Department of Records - City Clerk Department of police - Chief of police Department of Fire - Fire Chief Department of Public Works - Director of Public Works Department of Water - superintendent of Water Department of Community Services - Director of Community services Department of Library - Library Director f Department of Planning and Development Services - Director 0 Planning and Development Services i'D t Services - Management Serv ces Dlrector epartment of Managemen Department of Finance - Director of Finance Department of General Services - General Services Director Department of Personnel - Personnel Director SECTION IV, Subsection D of Section 2.20.040 of the Orange Municipal Code . ~ amended to read as follows, ~ Q D. Department Divisions. Organize his department into such divisions as are approved by the City Manager. SECTION VI, Subsection A.13 is hereby added to Section 2.20.060 of the Orange Municipal Code to read as follows: A.13: With th~ approval of the City Manager, holidays and days of mournlng, etc., WhlCh are decreed by the Mayor of the City, the Governor of the State, or the President of the United States of America. SECTION VII: Chapters 2.21, 2.23, 2.28, 2.32, 2.40, 2.44, 2.48, 2.52, Sections 2.21.010 through 2.52.040, of the Orange Municipal Code are hereby repealed. SECTION VIII: Chapters 2.22, 2.24, 2.26, 2.28, 2.30, 2.32, 2.34, 2.36, 2.38, 2.40, 2.42, 2.44, 2.46, and 2.48, Sections 2.22.010 through 2.48.010, are hereby added to the Orange Municipal Code to read as follows: Chapter 2.22 DEPARTMENT OF LAW Section: 2.22.010 Composition - Duties 2. 22.010 Composition - Duties. The Department of Law, super-Vlsed by the City Attorney, who shall be appointed by the City Council.The removal of City Attorney shall be only upon a three-member vote of the whole Council of the City at a regular Council meeting; subject,however, to the following provisions. In case of the intended r7rnoval by the City Council, the City Attorney s~al1 be furnished wlth the written notice stating the City Council s intention to remove said City Attorney. The effective date of such removal shall be shown upon the written notice. within seven (7) days after the delivery to the City Attorney of such notice, said City Attorney may, by written notification to the City Manager, request a hearing by the City Council. Thereafter, the City Council shall choose a time for the hearing which shall be held at its usual meeting place and at which the City Attorney shall appear and be heard. The City Attorney shall enforce all laws and act to protect the interests of the City and who shall: A. Advise Council. Advise the Councilor its committees of anf city <;,f~ice:, when thereto req~ested, upon all legal quest10ns ar~s~ng In. the conduct of C~ty Business. B. Prepare Ordlnances. Prepare or revise ordinances or resolutions when so requested by the Councilor any committee thereof. When the City Manager and City Attorney agree there is an emergency situation, prepare ordinances, resolutions or other documents for consideration by the Council. C. Give Opinions. Give his opinion upon any legal matter or questions submitted to him by the Council, or any of its committees, or by any City officer. D. Attend Meetings. Attend all Planning Commission and Council meetings in their entirety for the purpose of giving the Council any legal advise requested by its members. E. Prepare Legal Instruments. Prepare for execution all contracts and instruments to which the City is a party and shall approve, as to form, all bonds required to be submitted to the City. F. Prosecute Offenders. When authorized by the Council, prepare all charges and complaints and appear in the appropriate Court in the prosecution of every person charged with the violation of a City ordinance. G. Immediate Report of Decision. Immediately report the outcome of any litigation in which the City has an interest to the City Council and City Manager. H. Control Legal Services to Council Action. The City Treasurer shall receive as compensation the sum of $365.00 per month. CHAPTER 2.28 DEPARTMENT OF RECORDS Sections: 2.28.010 Members 2.28.020 City Clerk - Generally 2. 28.030 Chief Clerk - Appointment Duties 2.28. 040 Chief Clerk - Removal 2.28.050 Chief Clerk - Compensation 2.28.010 Members. The Department of Records shall consist of a City Clerk and a Chief Clerk.2.28.020 perform those shall receive City Clerk - Generally. A. The City Clerk shall functions required by State Law. B. The City Clerk as compensation the sum of $ 365.00 per month.2.28.030 Chief Clerk - Appointment Duties. A. The Chief Clerk shall be appointed by the City Council and serve at its pleasure and be responsible to both the city council and the City Manager in performing the administrative duties of that office.2.28.040 Chief Clerk- Removal. A. Vote required. The removal of Ch~ef Clerk shall be only upon a three-member vote of the whole Counc1l of the City at a regular Council meeting; subject, however,o the provisions of the next succeeding subsections. He will be responsible for the ma:Lntenance oflaw and order within the City in accordance with existing law, statue and/or resolution.CHAPTER 2. 32 DEPARTMENT OF FIRE section:2. 32. 010 Chief - Duties 2.32.010 Fire Chief - Duties. The Fire Chief shall manage the affairs of the Fire Department. The Fire Chief shall be charged with the prevention of fires and the protection of life and property against fire and shall: A. Report all fire losses to the City Manager.B. Be responsible for the maintenance and care of all property and equipment used by his department.CHAPTER 2.34 DEPARTMENT OF PUBLIC WORKS Section:2.34.010 Director - Duties 2.34.010 Director - Duties. The Director of Community Services shall be respons~ble for all matters relating to public recreation park planning, park development, social services and parks/street trees.The Director of community Services shall evaluate present and future needs for services, recommend policy, direct and participate in the preparation of department budget and reports.CHAPTER 2. 40 DEPARTMENT OF LIBRARY Section:2. 40. 010 Director - Duties 2.40.010 Director - Duties. The Library Director shall be responsible for all matters relating to library services. The Library Director shall evaluate present and future needs for services,recommend policy, direct and participate in the preparation and administration of the library budget, and prepare other reports as required.CHAPTER 2.42 DEPARTMENT OF PLANNING & DEVELOPMENT SERVICES Section:2.42.010 Director - Duties 2.42.010 Director _ Duties. The Director of Planning and Develop-ment Services is responsible for the preparation and/or review of a~l land use plans and the review of all de~elopments for <,:O?formance wl.th the City's General Plans and zoning ordlnance. The Department of Fin-ance shall be supervised by the Director of Finance, who shall administer the financial affairs of the City.CHAPTER 2.46 DEPARTMENT OF GENERAL SERVICES section:2.46. 010 Director - Duties 2.46.010 Director - Duties. Supervised by the General Services Director, the Department of General Services administers City operational and maintenance functions. The functions wi thin the department shall include, but not be limited to:A. Purchasing/Warehouse B. Vehicle Maintenance C. Building Maintenance D. Duplicating. CHAPTER 2.48 DEPARTMENT OF PERSONNEL Section:2. 48.010 Personnel Director - Duties 2.48.010 Personnel Director - Duties. Supervised by the Personnel Director, the Department of Personnel shall administer the City personnel U~ctions including, but not limited to, recruitment, testing, class-lhcation, benefit programs and employee records maintenance. The Department of Personnel shall provide counsel to the City Manager and departments concerning personnel-related matters.7- section IX: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general cir-culation, published and circulated in the City of Orange and shall take effect thirty (30) days from and after the date of its final passage.
